2019.<br><\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Dva ned\u00e1vne pr\u00edpady t\u00fdkaj\u00face sa ve\u013ek\u00e9ho internetov\u00e9ho kn\u00edhkupectva vyvol\u00e1vaj\u00fa ot\u00e1zky o vo\u013enosti zamestnancov pri spracovan\u00ed osobn\u00fdch \u00fadajov z\u00e1kazn\u00edkov spolo\u010dnosti.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Hoci spracovanie \u00fadajov je v s\u00fa\u010dasnosti podrobne regulovan\u00e9 z\u00e1konom a po\u010detn\u00fdmi usmerneniami \u2013 \u010di u\u017e ide o usmernenia CNIL alebo Eur\u00f3pskeho v\u00fdboru pre ochranu \u00fadajov (EDPB) \u2013 zodpovednosti v r\u00e1mci samotnej spolo\u010dnosti st\u00e1le vyvol\u00e1vaj\u00fa mnoho ot\u00e1zok.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Ak\u00e1 je zodpovednos\u0165 zamestn\u00e1vate\u013ea, pokia\u013e ide o to, ako jeho zamestnanci sprac\u00favaj\u00fa osobn\u00e9 \u00fadaje? Treba ma\u0165 na pam\u00e4ti nieko\u013eko z\u00e1sad:<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Rozsah p\u00f4sobnosti GDPR je \u0161irok\u00fd[1]. Automatizovan\u00e9 spracovanie osobn\u00fdch \u00fadajov v skuto\u010dnosti zah\u0155\u0148a oper\u00e1cie vykon\u00e1van\u00e9 s \u00fadajmi pomocou softv\u00e9ru tradi\u010dne pou\u017e\u00edvan\u00e9ho v podnikoch: napr\u00edklad datab\u00e1zy, e-mail, tabu\u013eky, ako aj pr\u00edpadne spracovanie \u00fadajov vykon\u00e1van\u00e9 pomocou softv\u00e9ru na spracovanie textu.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Zodpovednos\u0165 za konanie zamestnancov vo v\u0161eobecnosti nesie zamestn\u00e1vate\u013e pod\u013ea Ob\u010dianskeho z\u00e1konn\u00edka2, ale aj pod\u013ea GDPR, preto\u017ee zamestn\u00e1vate\u013e je prev\u00e1dzkovate\u013eom \u00fadajov: je to zamestn\u00e1vate\u013e, kto definuje prostriedky a \u00fa\u010dely spracovania v zmysle z\u00e1kona3.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Z rovnak\u00e9ho d\u00f4vodu bude zamestn\u00e1vate\u013e zodpovedn\u00fd v pr\u00edpade naru\u0161enia bezpe\u010dnosti, aj ke\u010f je d\u00f4sledkom konania zamestnanca, preto\u017ee pr\u00e1ve zamestn\u00e1vate\u013e m\u00e1 povinnos\u0165 zabezpe\u010di\u0165 \u00fadaje v r\u00e1mci svojej spolo\u010dnosti4.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Ak je zamestn\u00e1vate\u013e zodpovedn\u00fd vo\u010di tret\u00edm stran\u00e1m, m\u00f4\u017ee samozrejme podnikn\u00fa\u0165 kroky proti zamestnancovi, ktor\u00fd konal protipr\u00e1vne, najm\u00e4 za poru\u0161enie d\u00f4very alebo podvod, a ulo\u017ei\u0165 mu disciplin\u00e1rnu sankciu alebo dokonca prepustenie. Podvodn\u00fd pr\u00edstup alebo udr\u017eiavanie pr\u00edstupu k cel\u00e9mu automatizovan\u00e9mu syst\u00e9mu spracovania \u00fadajov alebo k jeho \u010dasti je tie\u017e trestn\u00fdm \u010dinom.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Nez\u00e1visle od zodpovednosti zamestn\u00e1vate\u013ea m\u00f4\u017ee zamestnanec nies\u0165 aj vlastn\u00fa zodpovednos\u0165 vo\u010di svojmu zamestn\u00e1vate\u013eovi, ale aj vo\u010di tret\u00edm stran\u00e1m: zamestnanec, ktor\u00fd sa odch\u00fdli od pokynov zamestn\u00e1vate\u013ea a sleduje svoje vlastn\u00e9 \u00fa\u010dely, sa s\u00e1m st\u00e1va zodpovedn\u00fdm za spracovanie v zmysle z\u00e1kona (pozri anal\u00fdzu Eur\u00f3pskej pracovnej skupiny k \u010dl\u00e1nku 296 \u2013 teraz EDPB).<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>To ist\u00e9 plat\u00ed, ak poru\u0161\u00ed IT chartu spolo\u010dnosti a pou\u017eije \u00fadaje pre svoj vlastn\u00fd \u00fa\u010det.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Na z\u00e1ver je nevyhnutn\u00e9, aby zamestn\u00e1vate\u013e prijal tieto opatrenia:<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Presne definova\u0165 \u00fa\u010dely a prostriedky spracovania a upozorni\u0165 zamestnancov na tento r\u00e1mec<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Nechajte ich podp\u00edsa\u0165 dolo\u017eku o ml\u010danlivosti pripojen\u00fa k pracovnej zmluve, ako aj IT chartu.<\/li>\n<!-- \/wp:list-item -->\n\n<!-- wp:list-item -->\n<li>Zapojte zodpovedn\u00fa osobu za ochranu \u00fadajov a zamestnaneck\u00fa radu do pr\u00edpravy t\u00fdchto dokumentov.<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list -->\n\n<!-- wp:paragraph -->\n<p>Tieto prevent\u00edvne opatrenia bud\u00fa ma\u0165 dvojak\u00fd pr\u00ednos: lep\u0161iu ochranu os\u00f4b, ktor\u00fdch \u00fadaje sa spracov\u00e1vaj\u00fa, a objasnenie zodpovednosti zamestn\u00e1vate\u013ea v pr\u00edpade zneu\u017eitia.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Treba poznamena\u0165, \u017ee zamestnanci maj\u00fa tie\u017e prospech z ochrany svojho s\u00fakromia \u2013 a svojich osobn\u00fdch \u00fadajov \u2013 na pracovisku. T\u00e1to t\u00e9ma bude predmetom \u010fal\u0161ieho v\u00fdvoja.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>A tie\u017e:<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>Vo Franc\u00fazsku:<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>CNIL 15. apr\u00edla zverejnila svoju spr\u00e1vu o \u010dinnosti a ozn\u00e1mila, \u017ee svoje bud\u00face audity zameria na dodr\u017eiavanie pr\u00e1v jednotlivcov, spracovanie \u00fadajov malolet\u00fdch a rozdelenie zodpovednost\u00ed medzi prev\u00e1dzkovate\u013ea a subdod\u00e1vate\u013ea.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>CNIL, ktorej teraz predsed\u00e1 Marie-Laure Denis, m\u00e1 nov\u00e9 kol\u00e9gium.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p><strong>V Eur\u00f3pe:<\/strong><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>D\u0148a 12. apr\u00edla EDPB prijal usmernenia t\u00fdkaj\u00face sa zhroma\u017e\u010fovania \u00fadajov v kontexte slu\u017eieb informa\u010dnej spolo\u010dnosti, pri\u010dom sa zameral najm\u00e4 na pr\u00e1vny z\u00e1klad pre zhroma\u017e\u010fovanie v kontexte zmluvn\u00e9ho vz\u0165ahu so z\u00e1kazn\u00edkom (\u010dl\u00e1nok 6 (1) (B) GDPR).
