T\u00e1to pr\u00e1vna forma je najjednoduch\u0161\u00edm a najbe\u017enej\u0161\u00edm sp\u00f4sobom, ako vykon\u00e1va\u0165 obchodn\u00fa, remeseln\u00fa alebo profesion\u00e1lnu \u010dinnos\u0165 vo vlastnom mene.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>\u017divnostensk\u00fd list (\u017dP) je ur\u010den\u00fd pre osobu, ktor\u00e1 chce vykon\u00e1va\u0165 obchodn\u00fa, remeseln\u00fa, slobodn\u00fa alebo po\u013enohospod\u00e1rsku \u010dinnos\u0165 vo vlastnom mene bez toho, aby musela zalo\u017ei\u0165 pr\u00e1vnick\u00fa osobu oddelen\u00fa od svojej osoby.<br \/>In\u0161tit\u00fat pre zamestn\u00e1vate\u013eov (EI) je forma podnikania vhodn\u00e1 pre \u010dinnosti, ktor\u00e9 si nevy\u017eaduj\u00fa v\u00fdznamn\u00fd kapit\u00e1l ani zamestnancov. Je vhodn\u00fd najm\u00e4 pre slobodn\u00e9 povolania (konzultanti, pr\u00e1vnici, lek\u00e1ri at\u010f.), remeseln\u00edci (in\u0161talat\u00e9ri, elektrik\u00e1ri at\u010f.), obchodn\u00edci (obchody, elektronick\u00fd obchod at\u010f.) alebo po\u013enohospod\u00e1ri. EI je vhodn\u00fd aj pre jednotlivcov, ktor\u00ed chc\u00fa vykon\u00e1va\u0165 odborn\u00fa \u010dinnos\u0165 samostatne a bez toho, aby boli podroben\u00ed administrat\u00edvnym a pr\u00e1vnym obmedzeniam spojen\u00fdm so zalo\u017een\u00edm spolo\u010dnosti so samostatnou pr\u00e1vnou subjektivitou.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><br \/>Treba v\u0161ak poznamena\u0165, \u017ee \u017eivnostn\u00edk vystavuje osobn\u00fd majetok podnikate\u013ea rizik\u00e1m spojen\u00fdm s jeho profesion\u00e1lnou \u010dinnos\u0165ou, preto\u017ee neexistuje oddelenie medzi osobn\u00fdm a profesion\u00e1lnym majetkom. V pr\u00edpade finan\u010dn\u00fdch \u0165a\u017ekost\u00ed spolo\u010dnosti m\u00f4\u017eu veritelia zabavi\u0165 osobn\u00fd majetok podnikate\u013ea na splatenie dlhov spolo\u010dnosti. \u017divnostn\u00edk ru\u010d\u00ed za spolo\u010dnos\u0165 neobmedzene, \u010do znamen\u00e1, \u017ee jeho osobn\u00fd majetok m\u00f4\u017ee by\u0165 v pr\u00edpade finan\u010dn\u00fdch \u0165a\u017ekost\u00ed spolo\u010dnosti zabaven\u00fd. Okrem toho \u017eivnostn\u00edk nem\u00e1 pr\u00e1vnu subjektivitu oddelen\u00fa od pr\u00e1vnej subjektivity \u017eivnostn\u00edka, \u010do znamen\u00e1, \u017ee spolo\u010dnos\u0165 nem\u00e1 vlastn\u00fd majetok.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>\u017divnostn\u00edk podlieha dani z pr\u00edjmu a \u017eivnostn\u00edk sa pova\u017euje za samostatne z\u00e1robkovo \u010dinn\u00fa osobu. Je preto zapojen\u00fd do syst\u00e9mu soci\u00e1lneho zabezpe\u010denia pre samostatne z\u00e1robkovo \u010dinn\u00e9 osoby a mus\u00ed prispieva\u0165 do soci\u00e1lnych organiz\u00e1ci\u00ed, aby mohol vyu\u017e\u00edva\u0165 soci\u00e1lne zabezpe\u010denie (soci\u00e1lne zabezpe\u010denie, d\u00f4chodkov\u00e9 poistenie, zdravotn\u00e9 poistenie at\u010f.). \u017divnostn\u00edk pon\u00faka v\u00fdhody, ako je jednoduch\u00e9 zalo\u017eenie, flexibilita riadenia, priazniv\u00e9 zda\u0148ovanie pre n\u00edzke pr\u00edjmy a sloboda \u017eivnostn\u00edka.
