{"id":14042,"date":"2026-05-06T15:25:01","date_gmt":"2026-05-06T15:25:01","guid":{"rendered":"https:\/\/viqtor.eu\/lintelligence-artificielle-comme-outil-de-travail-quel-encadrement\/"},"modified":"2026-05-06T15:25:01","modified_gmt":"2026-05-06T15:25:01","slug":"lintelligence-artificielle-comme-outil-de-travail-quel-encadrement","status":"publish","type":"post","link":"https:\/\/viqtor.eu\/sk\/umela-inteligencia-ako-pracovny-nastroj-aky-ramec-je-potrebny\/","title":{"rendered":"Umel\u00e1 inteligencia ako pracovn\u00fd n\u00e1stroj: ak\u00fd druh r\u00e1mca je potrebn\u00fd?"},"content":{"rendered":"<p><strong>Pr\u00e1vny preh\u013ead \u010d. 77 \u2013 november 2024.&nbsp; <\/strong><\/p>\n<h3><strong><u>Umel\u00e1 inteligencia ako pracovn\u00fd n\u00e1stroj: ak\u00fd druh r\u00e1mca je potrebn\u00fd?<\/u><\/strong><\/h3>\n<p>Pou\u017e\u00edvanie umelej inteligencie na pracovisku dnes prudko rastie, \u010dasto bez predch\u00e1dzaj\u00faceho prem\u00fd\u0161\u013eania a bez toho, aby zamestn\u00e1vate\u013e presne vedel, ako jeho zamestnanci nov\u00e9 n\u00e1stroje, ktor\u00e9 m\u00e1 k dispoz\u00edcii, pou\u017e\u00edvaj\u00fa.<\/p>\n<p>\u010ci u\u017e ide o dnes u\u017e klasick\u00e9 jazykov\u00e9 modely ako ChatGPT, alebo n\u00e1stroje, ktor\u00e9 umo\u017e\u0148uj\u00fa vytv\u00e1ra\u0165 grafick\u00fd dizajn (Canva), extrahova\u0165 d\u00e1ta z webu (Browse AI) alebo automaticky robi\u0165 pozn\u00e1mky po\u010das stretnutia (Fireflies), mo\u017enost\u00ed je nespo\u010detn\u00e9 mno\u017estvo.<\/p>\n<p>Pod\u013ea \u0161t\u00fadie IFOP pre Learnthings z decembra 2023 takmer ka\u017ed\u00fd \u0161tvrt\u00fd zamestnanec u\u017e pou\u017eil n\u00e1stroj umelej inteligencie v profesion\u00e1lnom kontexte a z nich viac ako polovica (55 %) tak urobila bez toho, aby o tom informovala svojho mana\u017e\u00e9ra.<\/p>\n<p>Pochopenie toho, ako sa tieto n\u00e1stroje pou\u017e\u00edvaj\u00fa interne, je v\u0161ak nevyhnutn\u00e9 na zabezpe\u010denie s\u00faladu s platn\u00fdm pr\u00e1vnym r\u00e1mcom, a najm\u00e4 s eur\u00f3pskym nariaden\u00edm o umelej inteligencii a GDPR.<\/p>\n<p>Nieko\u013eko org\u00e1nov vr\u00e1tane ANSSI a CNIL publikovalo odpor\u00fa\u010dania zameran\u00e9 na zv\u00fd\u0161enie povedomia medzi profesion\u00e1lnymi pou\u017e\u00edvate\u013emi. Tu s\u00fa hlavn\u00e9 body:<\/p>\n<p><strong>Implement\u00e1cia charty umelej inteligencie<\/strong> v r\u00e1mci spolo\u010dnosti, aby<\/p>\n<ul style=\"list-style-type: square;\">\n<li>Vymenujte povolen\u00e9 n\u00e1stroje;<\/li>\n<li>Zmapujte tieto n\u00e1stroje pod\u013ea riz\u00edk v s\u00falade s nariaden\u00edm o umelej inteligencii;<\/li>\n<li>Regul\u00e1cia vysoko rizikov\u00fdch syst\u00e9mov (napr. odborn\u00e9 vzdel\u00e1vanie a n\u00e1bor \u013eudsk\u00fdch zdrojov, kde pou\u017e\u00edvanie umelej inteligencie predstavuje riziko \u201eautomatiz\u00e1cie diskrimin\u00e1cie\u201c).<\/li>\n<\/ul>\n<p><strong>Organizujte soci\u00e1lny dial\u00f3g<\/strong>, konzultova\u0165 s CSE a zmeni\u0165 intern\u00e9 pracovn\u00e9 pravidl\u00e1 tak, aby boli tieto pravidl\u00e1 vym\u00e1hate\u013en\u00e9 interne.<\/p>\n<p><strong>Zabezpe\u010denie bezpe\u010dnosti \u00fadajov<\/strong> Poskytovanie osobn\u00fdch \u00fadajov syst\u00e9mu umelej inteligencie (napr. \u00fadajov o z\u00e1kazn\u00edkoch alebo zamestnancoch) alebo citlivej \u010di strategickej dokument\u00e1cie m\u00f4\u017ee ma\u0165 v\u00fdznamn\u00e9 d\u00f4sledky z h\u013eadiska d\u00f4vernosti.<\/p>\n<p>Okrem toho, pou\u017e\u00edvanie tak\u00e9hoto syst\u00e9mu m\u00f4\u017ee ma\u0165 vplyv na integritu informa\u010dn\u00e9ho syst\u00e9mu, ku ktor\u00e9mu je pripojen\u00fd.<\/p>\n<p>CNIL odpor\u00fa\u010da uprednostni\u0165 nasadenie rie\u0161en\u00ed \u201ena mieste\u201c, ktor\u00e9 obmedzuj\u00fa rizik\u00e1 extrakcie \u00fadajov od tretej strany.<\/p>\n<p>Hoci m\u00f4\u017ee by\u0165 ekonomickej\u0161ie pou\u017e\u00edva\u0165 syst\u00e9m hostovan\u00fd v cloude, bude potrebn\u00e9 ma\u0165 subdod\u00e1vate\u013esk\u00fa zmluvu, ktor\u00e1 \u0161pecifikuje r\u00f4zne zodpovednosti a opr\u00e1vnen\u00fd pr\u00edstup k spracovan\u00fdm \u00fadajom.&nbsp;<\/p>\n<p>V tomto pr\u00edpade sa odpor\u00fa\u010da obmedzi\u0165 poskytovanie osobn\u00fdch \u00fadajov syst\u00e9mu umelej inteligencie.<\/p>\n<p><strong>\u0160koli\u0165 a zvy\u0161ova\u0165 povedomie<\/strong> Koncov\u00ed pou\u017e\u00edvatelia by mali dodr\u017eiava\u0165 tieto osved\u010den\u00e9 postupy:<\/p>\n<ul style=\"list-style-type: square;\">\n<li>Poskytujte iba \u00fadaje, na ktor\u00fdch zdie\u013eanie m\u00e1te opr\u00e1vnenie, pri\u010dom v z\u00e1sade vylu\u010dujte ak\u00e9ko\u013evek d\u00f4vern\u00e9 \u00fadaje.<\/li>\n<li>Overi\u0165 presnos\u0165 a kvalitu \u00fadajov generovan\u00fdch syst\u00e9mom, absenciu plagi\u00e1torstva a riziko diskrimin\u00e1cie;<\/li>\n<li>Nereprodukujte v\u00fdstupy syst\u00e9mu presne tak, ako s\u00fa, aby ste si zachovali kritick\u00fd poh\u013ead.<\/li>\n<\/ul>\n<p><strong>Zabezpe\u010denie transparentnosti pri spracovan\u00ed<\/strong>, najm\u00e4 tie, ktor\u00e9 generuj\u00fa automatizovan\u00e9 rozhodnutia t\u00fdkaj\u00face sa zamestnancov a tret\u00edch str\u00e1n mimo spolo\u010dnosti.<\/p>\n<p><strong>Zavies\u0165 riadenie<\/strong> : ur\u010di\u0165 zodpovedn\u00fa osobu, v\u00fdbor alebo referenta (vr\u00e1tane CISO), aby koncov\u00fdm pou\u017e\u00edvate\u013eom poskytol kontaktn\u00fd bod na nastolenie etick\u00fdch ot\u00e1zok alebo \u0165a\u017ekost\u00ed a overenie dodr\u017eiavania pravidiel.<\/p>\n<p>Okrem sankci\u00ed stanoven\u00fdch v GDPR a nariaden\u00ed o umelej inteligencii predstavuje prijatie jasn\u00e9ho r\u00e1mca aj soci\u00e1lnu a etick\u00fa ot\u00e1zku, a to v z\u00e1ujme \u013eud\u00ed extern\u00fdch aj intern\u00fdch vo\u010di spolo\u010dnosti.<\/p>\n<h4>&nbsp;<\/h4>\n<h4><strong><img decoding=\"async\" src=\"https:\/\/viqtor.eu\/wp-content\/uploads\/2026\/05\/france_1773239943859.jpg\" alt=\"\" width=\"145\" height=\"97\"> &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;<\/strong><\/h4>\n<p>CNIL zverej\u0148uje ak\u010dn\u00fd pl\u00e1n na podporu akt\u00e9rov v striebornej ekonomike, sektore zameranom na aktivity v prospech seniorov.<\/p>\n<p>Poukazuje na to, \u017ee seniori bud\u00fa do roku 2060 vo Franc\u00fazsku predstavova\u0165 pribli\u017ene 24 mili\u00f3nov \u013eud\u00ed a \u017ee \u201epovaha spracov\u00e1van\u00fdch \u00fadajov a cielenie na z\u00e1klade veku vyvol\u00e1va zna\u010dn\u00e9 ot\u00e1zky t\u00fdkaj\u00face sa ochrany \u00fadajov\u201c.<\/p>\n<p>M\u00e1 v \u00famysle aktualizova\u0165 svoj bal\u00edk dokument\u00e1cie (informa\u010dn\u00e9 listy, odpor\u00fa\u010dania at\u010f.) a navrhuje nov\u00fd \u201epieskovisko\u201c na podporu troch inovat\u00edvnych projektov v tomto sektore.<\/p>\n<p>CNIL a DGCCRF 18. novembra ozn\u00e1mili podp\u00edsanie nov\u00e9ho protokolu o spolupr\u00e1ci, ktor\u00fdm sa aktualizuje dohoda z roku 2011.<\/p>\n<p>Oba org\u00e1ny posil\u0148uj\u00fa svoju spolupr\u00e1cu a vyv\u00edjaj\u00fa nov\u00e9 cesty k zdie\u013eaniu inform\u00e1ci\u00ed s cie\u013eom prisp\u00f4sobi\u0165 sa zmen\u00e1m v legislat\u00edve a ekonomick\u00fdm v\u00fdzvam digit\u00e1lneho veku.<\/p>\n<p>V publik\u00e1cii z 19. novembra CNIL tie\u017e opakuje z\u00e1sady ochrany \u00fadajov platn\u00e9 pre pou\u017e\u00edvanie roz\u0161\u00edren\u00fdch kamier v priestore pre cestuj\u00facich v n\u00e1kladn\u00fdch vozidl\u00e1ch a trv\u00e1 na tom, \u017ee zamestn\u00e1vate\u013e mus\u00ed prija\u0165 v\u0161etky potrebn\u00e9 opatrenia na zabezpe\u010denie s\u00faladu tak\u00fdchto kamier s predpismi pred ich in\u0161tal\u00e1ciou.<\/p>\n<p>CNIL 25. novembra zverejnila s\u00e9riu tipov na ochranu va\u0161ich \u00fadajov pri interakcii s hlasov\u00fdm asistentom.<\/p>\n<p>Zamestnanec, ktor\u00fd vykon\u00e1va pr\u00edkazy poru\u0161uj\u00face GDPR, sa vystavuje trestnej zodpovednosti, a to aj v pr\u00edpade, \u017ee kon\u00e1 na z\u00e1klade pokynov svojho zamestn\u00e1vate\u013ea.<\/p>\n<p>Na trestnom s\u00fade v Nantes pr\u00e1ve po\u017eiadal prokur\u00e1tor o pokutu 6 000 eur, z ktorej je 3 000 eur podmiene\u010dne vyplaten\u00fdch, pre zamestnanca IT subdod\u00e1vate\u013eskej spolo\u010dnosti za to, \u017ee na pr\u00edkaz svojho \u0161\u00e9fa nain\u0161taloval \u0161pion\u00e1\u017ene zariadenie v priestoroch svojich klientov.<\/p>\n<p>Prokur\u00e1tor po\u017eaduje pre \u0161\u00e9fa dev\u00e4\u0165mesa\u010dn\u00fd podmiene\u010dn\u00fd trest od\u0148atia slobody a pokutu 30 000 eur.<\/p>\n<p>Odvolac\u00ed s\u00fad v Par\u00ed\u017ei vo svojom rozhodnut\u00ed vydanom 21. novembra 2024 potvrdil rozsudok vydan\u00fd Priemyseln\u00fdm tribun\u00e1lom v Meaux 23. j\u00fala 2021: s\u00fakromn\u00e1 konverz\u00e1cia v aplik\u00e1cii Messenger, ktor\u00e1 p\u00f4vodne nemala by\u0165 zverejnen\u00e1, sa nem\u00f4\u017ee pova\u017eova\u0165 za poru\u0161enie zmluvn\u00fdch povinnost\u00ed zamestnanca a disciplin\u00e1rne prepustenie z tak\u00fdchto d\u00f4vodov nemo\u017eno legit\u00edmne od\u00f4vodni\u0165.<\/p>\n<p>S\u00fad sa odvol\u00e1va na rozhodnutie Kasa\u010dn\u00e9ho s\u00fadu z 22. decembra 2023 v tej istej veci.<\/p>\n<p>Toto zd\u00f4vodnenie plat\u00ed aj v pr\u00edpade, \u017ee by sa zamestn\u00e1vate\u013e, ako v prejedn\u00e1vanej veci, nesna\u017eil z\u00edska\u0165 pr\u00edstup k t\u00fdmto inform\u00e1ci\u00e1m: po\u010das nepr\u00edtomnosti zamestnankyne ju po\u017eiadal o poskytnutie svojich identifik\u00e1torov, aby umo\u017enil kolegom pr\u00edstup k jej pracovn\u00fdm dokumentom, a spr\u00e1vy sa zobrazili na obrazovke, ke\u010f sa konverz\u00e1cia automaticky otvorila.<\/p>\n<h4>&nbsp;<\/h4>\n<h4><img decoding=\"async\" GDPR.<\/p>\n<p>Tieto usmernenia sa t\u00fdkaj\u00fa \u017eiadost\u00ed o priamu spolupr\u00e1cu medzi verejn\u00fdm org\u00e1nom tretej krajiny (ako s\u00fa bankov\u00e9 regula\u010dn\u00e9 org\u00e1ny, da\u0148ov\u00e9 org\u00e1ny, org\u00e1ny \u010dinn\u00e9 v trestnom konan\u00ed alebo n\u00e1rodn\u00e1 bezpe\u010dnos\u0165) a s\u00fakromn\u00fdm subjektom Eur\u00f3pskej \u00fanie (E\u00da).<\/p>\n<p>Pripomienky je mo\u017en\u00e9 posiela\u0165 do 27. janu\u00e1ra 2025.<\/p>\n<p>EDPB tie\u017e za\u010diatkom decembra prijal vyhl\u00e1senie t\u00fdkaj\u00face sa druhej spr\u00e1vy Eur\u00f3pskej komisie o uplat\u0148ovan\u00ed GDPR, v ktorom zd\u00f4raz\u0148uje d\u00f4le\u017eitos\u0165 s\u00faladu medzi digit\u00e1lnou legislat\u00edvou a GDPR.<\/p>\n<p>EDPB zintenz\u00edvni tvorbu obsahu pre neodborn\u00edkov vr\u00e1tane mal\u00fdch a stredn\u00fdch podnikov a zd\u00f4raz\u0148uje potrebu dodato\u010dn\u00fdch finan\u010dn\u00fdch a \u013eudsk\u00fdch zdrojov, ktor\u00e9 pom\u00f4\u017eu org\u00e1nom na ochranu \u00fadajov (DPA) vyrovna\u0165 sa s \u010doraz zlo\u017eitej\u0161\u00edmi v\u00fdzvami a z\u00edska\u0165 \u010fal\u0161ie zru\u010dnosti, a to aj v oblasti umelej inteligencie.<\/p>\n<p>V\u00ed\u0165azstvo kandid\u00e1ta protieur\u00f3pskej opoz\u00edcie v prvom kole rumunsk\u00fdch prezidentsk\u00fdch volieb 24. novembra m\u00e1 d\u00f4sledky na eur\u00f3pskej \u00farovni.<\/p>\n<p>Zatia\u013e \u010do \u00dastavn\u00fd s\u00fad krajiny pr\u00e1ve zru\u0161il toto prv\u00e9 kolo volieb po odtajnen\u00ed Eur\u00f3py prijal 28. novembra metodiku (HUDERIA) na posudzovanie riz\u00edk a vplyvov syst\u00e9mov umelej inteligencie z h\u013eadiska \u013eudsk\u00fdch pr\u00e1v, demokracie a pr\u00e1vneho \u0161t\u00e1tu.<\/p>\n<p>T\u00fato metodiku m\u00f4\u017eu verejn\u00ed aj s\u00fakromn\u00ed akt\u00e9ri pou\u017ei\u0165 na pomoc pri identifik\u00e1cii a rie\u0161en\u00ed t\u00fdchto riz\u00edk a vplyvov po\u010das cel\u00e9ho \u017eivotn\u00e9ho cyklu syst\u00e9mov umelej inteligencie.<\/p>\n<p>V polovici novembra zverejnil Fond digit\u00e1lnej slobody v r\u00e1mci projektu digiRISE komplexn\u00fa datab\u00e1zu o kolekt\u00edvnom uplat\u0148ovan\u00ed n\u00e1rokov na n\u00e1pravu v Eur\u00f3pe, ktor\u00e1 je ur\u010den\u00e1 na podporu kolekt\u00edvnej \u017ealoby na obranu digit\u00e1lnych pr\u00e1v pod\u013ea Charty z\u00e1kladn\u00fdch pr\u00e1v E\u00da.<\/p>\n<p>Dokument obsahuje zdroje o tom, ako desa\u0165 \u010dlensk\u00fdch \u0161t\u00e1tov E\u00da zaviedlo opatren\u00edm.<\/p>\n<p>Tieto z\u00e1kony umo\u017e\u0148uj\u00fa tis\u00edckam pou\u017e\u00edvate\u013eov by\u0165 zastupovan\u00ed a po\u017eadova\u0165 napr\u00edklad n\u00e1hradu nemajetkovej ujmy, ak boli ich osobn\u00e9 \u00fadaje spracovan\u00e9 nez\u00e1konne.<\/p>\n<p>Na rozdiel od americk\u00fdch hromadn\u00fdch \u017eal\u00f4b eur\u00f3pska legislat\u00edva vy\u017eaduje, aby boli tieto \u017ealoby podan\u00e9 na neziskov\u00e9 \u00fa\u010dely.<\/p>\n<p>Spolo\u010dnos\u0165 Meta op\u00e4\u0165 prehodnocuje svoje pl\u00e1ny t\u00fdkaj\u00face sa distrib\u00facie personalizovanej (DMA).<\/p>\n<p>Nov\u00e1 ponuka zah\u0155\u0148a predplatn\u00e9 bez rekl\u00e1m za zn\u00ed\u017een\u00fa cenu a tie\u017e predstavuje bezplatn\u00fd model, ktor\u00fd sa vyzna\u010duje zobrazovan\u00edm \u201emenej personalizovan\u00fdch rekl\u00e1m\u201c so s\u00fahlasom.<\/p>\n<p>Max Schrems, ktor\u00fd inicioval nieko\u013eko \u017eal\u00f4b proti spolo\u010dnosti Meta, uviedol, \u017ee \u201ecelkovo to vyzer\u00e1 ako \u010fal\u0161\u00ed pokus ignorova\u0165 eur\u00f3psku legislat\u00edvu (...) pou\u017e\u00edvatelia musia ma\u0165 skuto\u010dn\u00fa vo\u013ebu medzi
