menor.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Al\u00e9m das condi\u00e7\u00f5es de trabalho que devem ser adaptadas, h\u00e1 a quest\u00e3o dos dados que podem ou mesmo devem ser coletados e tratados no \u00e2mbito da rela\u00e7\u00e3o de trabalho.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>O empregador encontra-se, por um lado, sujeito a <strong>a obriga\u00e7\u00e3o legal de preservar a sa\u00fade<\/strong> dos seus colaboradores, enquanto que por outro lado os dados de sa\u00fade s\u00e3o considerados por lei como <strong>dados sens\u00edveis<\/strong>, cujas condi\u00e7\u00f5es de processamento s\u00e3o estritamente regulamentadas.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>O recente lembrete da CNIL sobre o quadro a ser respeitado e sobre as medidas concretas que podem ser implementadas no local de trabalho \u00e9, portanto, bem-vindo.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Os seguintes elementos s\u00e3o mantidos:<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Embora o processamento de dados de sa\u00fade seja, em princ\u00edpio, proibido, ele continua sendo poss\u00edvel sob certas condi\u00e7\u00f5es, dependendo das finalidades buscadas.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Assim, no contexto da pandemia, o empregador pode validamente:<\/p>\n<!-- \/wp:paragraph --><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Informe os seus colaboradores sobre as medidas de barreira, forne\u00e7a-lhes todos os equipamentos de prote\u00e7\u00e3o necess\u00e1rios e relembre-os da obriga\u00e7\u00e3o de os informar ou de informar as autoridades sanit\u00e1rias competentes em caso de contamina\u00e7\u00e3o ou suspeita de contamina\u00e7\u00e3o, com o \u00fanico objetivo de lhes permitir adaptar as condi\u00e7\u00f5es de trabalho (teletrabalho, por exemplo).<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:list -->\n<ul><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Promover m\u00e9todos de trabalho remoto e incentivar o uso da medicina do trabalho.<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Como parte da implementa\u00e7\u00e3o de um Plano de Continuidade de Neg\u00f3cios para proteger a seguran\u00e7a dos funcion\u00e1rios e identificar atividades essenciais que devem ser mantidas, crie um arquivo nominativo para o desenvolvimento e manuten\u00e7\u00e3o do plano, limitado aos dados necess\u00e1rios para atingir esse objetivo.<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:paragraph -->\n<p>O empregador s\u00f3 pode acessar certas informa\u00e7\u00f5es restritas para tomar as medidas organizacionais necess\u00e1rias, enquanto dados mais diretamente relacionados \u00e0 sa\u00fade devem ser processados por um profissional de sa\u00fade.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>(Por exemplo, para prolongar uma quarentena e justificar o teletrabalho) e no \u00e2mbito dos servi\u00e7os de sa\u00fade ocupacional:<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>O empregador n\u00e3o est\u00e1 autorizado a realizar um diagn\u00f3stico do estado de sa\u00fade de cada um dos seus empregados nem a gerir ele pr\u00f3prio um sistema de avalia\u00e7\u00e3o da sua vulnerabilidade (por exemplo, atrav\u00e9s de um c\u00f3digo de cores).<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>De acordo com a legisla\u00e7\u00e3o vigente, a coleta eletr\u00f4nica de temperaturas ou por meio de c\u00e2mera t\u00e9rmica com reten\u00e7\u00e3o de dados, testes sorol\u00f3gicos e question\u00e1rios de sa\u00fade n\u00e3o podem ser implementados pelo empregador. A situa\u00e7\u00e3o seria diferente da aferi\u00e7\u00e3o manual de temperatura sem reten\u00e7\u00e3o de dados: tal pr\u00e1tica n\u00e3o se enquadra no escopo do GDPR, mas pode levantar outras quest\u00f5es de efic\u00e1cia.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Por fim, ainda devido \u00e0 natureza sens\u00edvel dos dados processados, a maior aten\u00e7\u00e3o deve ser dada \u00e0s medidas de seguran\u00e7a que garantam a confidencialidade dos dados processados.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Em resumo, as principais medidas que o empregador est\u00e1 autorizado a tomar dizem respeito \u00e0 organiza\u00e7\u00e3o do trabalho, com base em dados limitados aos riscos de exposi\u00e7\u00e3o dos empregados, enquanto a gest\u00e3o de dados mais diretamente relacionados \u00e0 doen\u00e7a \u00e9 de responsabilidade direta dos profissionais de sa\u00fade.
