Bilo je prekrasno, nova ekonomija, horizontalnost, uberizacija, umjetna inteligencija. Podaci, kakav hobi! I svi smo i\u0161li za tim, do kraja! Kriza? Moje oko. Ne za svakoga, i ne za sve. Nikada mali ljudi nisu toliko proizvodili, prodavali i kupovali. Da bismo izbjegli propast, mi prodajemo. \u010cak i ako to zna\u010di kolaps. Svako ime i svaki dio informacije povezan s tim imenom vrijedio je \u010duvanja, testiranja, profiliranja. Svima ne\u0161to treba, jednog dana. Europske vlasti reagiraju i mo\u017eemo razumjeti za\u0161to.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Prije obrade podataka morate provesti procjenu utjecaja, pridr\u017eavati se kodeksa pona\u0161anja koji \u0107e regulirati prakse u va\u0161em sektoru i imenovati slu\u017ebenika za za\u0161titu podataka koji \u0107e o svim incidentima izvje\u0161tavati nadzorno tijelo, CNIL u Francuskoj. Dosta je dosta.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>S Webom 2.0 shvatili smo da bogatstvo le\u017ei u podacima, \u0161to je dovelo do svemo\u0107ne prirode velikih podataka danas. Ta je mo\u0107 takva da se neki pitaju ima li pojam granice izme\u0111u javnog i privatnog \u017eivota jo\u0161 uvijek ikakvo zna\u010denje. Nije li prekasno? pitaju se drugi. Inicijatori GDPR-a ne misle tako, ili barem ne ka\u017eu tako. Po njihovom mi\u0161ljenju, mo\u017eemo i moramo intervenirati kako nas podatkovni centri i oni koji ih posjeduju ne bi razvlastili ili povampirili.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Ovo njihanje njihala je u zraku. Studija tvrtke P\u00e9gasystems provedena me\u0111u 7000 potro\u0161a\u010da u prolje\u0107e 2017. u sedam zemalja Europske unije pokazuje da je 82% gra\u0111ana odlu\u010dilo ostvariti svoja prava prema GDPR-u. S obzirom na rastu\u0107u zabrinutost gra\u0111ana za priznavanje njihovih prava, ove se brojke ne smiju shvatiti olako.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Izgradnja povjerenja, kombiniranje za\u0161tite i slobodnog kretanja<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>GDPR stoga nije tekst koji se mo\u017ee brzo zaboraviti nakon datuma stupanja na snagu. Pa \u010dak i &quot;Obrada osobnih podataka trebala bi biti osmi\u0161ljena da slu\u017ei \u010dovje\u010danstvu&quot; (4<sup>e<\/sup> s obzirom).<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Ako se osje\u0107a potreba za za\u0161titom, to je zato \u0161to su \u010dlanovi Europskog parlamenta i Vije\u0107a, predstavni\u010dki predstavnici gra\u0111ana EU-a, smatrali da su tvrtke, a u nekim slu\u010dajevima mo\u017eda i uprave, oti\u0161le predaleko u iskori\u0161tavanju osobnih podataka. Tehnologije omogu\u0107uju i privatnim tvrtkama i javnim tijelima da koriste osobne podatke u svojim poslovnim aktivnostima kao nikada prije. Pojedinci sve vi\u0161e javno i globalno objavljuju informacije o sebi. Tehnologije su transformirale i ekonomske i dru\u0161tvene odnose te bi trebale dodatno olak\u0161ati slobodan protok osobnih podataka unutar Unije i njihov prijenos u tre\u0107e zemlje i me\u0111unarodne organizacije, uz osiguranje visoke razine za\u0161tite osobnih podataka.\u201c<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Jasno je da EU ne krivi jednu stranu vi\u0161e od druge, ve\u0107 pokazuje zajedni\u010dku odgovornost poduze\u0107a, javnih vlasti, tehnologije i samih pojedinaca.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Ni Europa nije izuzeta, od 9.<sup>e<\/sup> budu\u0107i da se u njoj navodi: \u201eIako je i dalje zadovoljavaju\u0107a u smislu svojih ciljeva i na\u010dela, Direktiva 95\/46\/EZ (prvi europski referentni tekst o toj temi) nije sprije\u010dila fragmentaciju u provedbi za\u0161tite podataka u Uniji, pravnu nesigurnost ili ra\u0161ireni javni osje\u0107aj da i dalje postoje zna\u010dajni rizici za za\u0161titu pojedinaca, posebno u online okru\u017eenju.\u201c<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Glavni utvr\u0111eni problem je razlika u razinama za\u0161tite me\u0111u zemljama. Stoga se \u010dini da je jedinstvo, za sve tvrtke diljem EU-a, pa \u010dak i za njihove podizvo\u0111a\u010de izvan EU-a, uvjet sine qua non za u\u010dinkovitu politiku u ovom podru\u010dju. \u201eKako bi se osigurala dosljedna i visoka razina za\u0161tite pojedinaca i uklonile prepreke protoku osobnih podataka unutar Unije, razina za\u0161tite prava i sloboda pojedinaca u vezi s obradom takvih podataka trebala bi biti jednaka u svim dr\u017eavama \u010dlanicama. Stoga je primjereno osigurati dosljednu i ujedna\u010denu primjenu pravila za za\u0161titu temeljnih prava i sloboda pojedinaca u vezi s obradom osobnih podataka diljem Unije\u201c (10<sup>e<\/sup> s obzirom).<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Tekst, iako vrlo restriktivan, kako \u0107emo vidjeti, ipak ima pozitivan ekonomski cilj: \u201eOvi doga\u0111aji zahtijevaju \u010dvrst i koherentniji okvir za\u0161tite podataka u Uniji, uz strogu primjenu pravila, jer je va\u017eno stvoriti povjerenje koje \u0107e omogu\u0107iti razvoj digitalnog gospodarstva na cijelom unutarnjem tr\u017ei\u0161tu\u201c (7<sup>e<\/sup> s obzirom).<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>\u201ePovjerenje.\u201c Po na\u0161em mi\u0161ljenju, ovo je najva\u017enija rije\u010d. Ako GDPR ima za cilj jam\u010diti, vratiti ili \u201eusaditi\u201c povjerenje gra\u0111ana u javne i privatne dionike na jedinstvenom europskom tr\u017ei\u0161tu, onda ga svim srcem podr\u017eavamo. Bitno je da ljudi koji kupuju putem interneta, koriste uslugu, pregledavaju ponude ili izra\u017eavaju mi\u0161ljenje mogu provoditi te radnje bez straha da \u0107e biti li\u0161eni dijela svoje privatnosti.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Bez straha od oduzimanja imovine ili \u010dak uznemiravanja, da upotrijebimo popularan izraz od kraja 2017. koji bi se mogao primijeniti na digitalnu tehnologiju. Koliko puta dnevno primamo informacije koje nikada nismo tra\u017eili, navodno zato \u0161to smo se pretplatili na ne\u0161to za \u0161to nismo ni znali da postoji? Danas se moramo odjaviti iako nikada nismo bili pretpla\u0107eni. Ekonomska razmjena nikada nije toliko plodna kao kada razli\u010dite strane osje\u0107aju povjerenje jedna u drugu.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Ove fluidne razmjene informacija jasno se poti\u010du: \u201eKako bi se osigurala dosljedna razina za\u0161tite pojedinaca u cijeloj Uniji i kako bi se izbjegle razlike koje ometaju slobodan protok osobnih podataka unutar unutarnjeg tr\u017ei\u0161ta, potrebna je uredba kojom \u0107e se osigurati pravna sigurnost i transparentnost za gospodarske subjekte, uklju\u010duju\u0107i mikro, mala i srednja poduze\u0107a, kako bi se fizi\u010dkim osobama u svim dr\u017eavama \u010dlanicama osigurala ista razina provedivih prava, obveza i odgovornosti za kontrolore i obra\u0111iva\u010de te kako bi se osigurao dosljedan nadzor nad obradom osobnih podataka i ekvivalentne kazne u svim dr\u017eavama \u010dlanicama, kao i u\u010dinkovita suradnja izme\u0111u nadzornih tijela razli\u010ditih dr\u017eava \u010dlanica. Da bi unutarnje tr\u017ei\u0161te pravilno funkcioniralo, nu\u017eno je da slobodan protok osobnih podataka unutar Unije nije ni ograni\u010den ni zabranjen iz razloga koji se odnose na za\u0161titu pojedinaca u vezi s obradom osobnih podataka\u201c (13)<sup>e<\/sup> s obzirom).<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Kao \u0161to vidimo, za\u0161tita podataka ne bi trebala biti prepreka, ve\u0107 prednost \u201eza pravilno funkcioniranje unutarnjeg tr\u017ei\u0161ta\u201c. \u010clanak 1. GDPR-a uklju\u010duje ovu kombinaciju dvaju ciljeva.
