tijekom COVID-19?<\/strong> Me\u0111u izazovima s kojima se na\u0161a dru\u0161tva suo\u010davaju u kontekstu zdravstvene krize, onaj s kojim se suo\u010davaju poslodavci nije najmanje va\u017ean.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Uz uvjete rada koji se moraju prilagoditi, postavlja se i pitanje podataka koji se mogu ili \u010dak moraju prikupljati i obra\u0111ivati u okviru radnog odnosa.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Poslodavac se, s jedne strane, nalazi podlo\u017ean <strong>zakonska obveza o\u010duvanja zdravlja<\/strong> svojih zaposlenika, dok se s druge strane zdravstveni podaci zakonom smatraju <strong>osjetljivi podaci<\/strong>, \u010diji su uvjeti obrade strogo regulirani.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Nedavni podsjetnik CNIL-a o okviru koji treba po\u0161tivati i o konkretnim mjerama koje se mogu provesti na radnom mjestu je stoga dobrodo\u0161ao.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Sljede\u0107i elementi su zadr\u017eani:<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Iako je obrada zdravstvenih podataka u na\u010delu zabranjena, ona je i dalje mogu\u0107a pod odre\u0111enim uvjetima, ovisno o svrhama koje se \u017eele posti\u0107i.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Dakle, u kontekstu pandemije, poslodavac mo\u017ee valjano:<\/p>\n<!-- \/wp:paragraph --><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Obavijestite svoje zaposlenike o za\u0161titnim mjerama, osigurajte im svu potrebnu za\u0161titnu opremu i podsjetite ih na obvezu da ih obavijestite ili obavijestite nadle\u017ena zdravstvena tijela u slu\u010daju kontaminacije ili sumnje na kontaminaciju, s isklju\u010divom svrhom da im se omogu\u0107i prilagodba uvjeta rada (npr. rad na daljinu).<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Kao dio provedbe Plana kontinuiteta poslovanja radi za\u0161tite sigurnosti zaposlenika i identificiranja bitnih aktivnosti koje se moraju odr\u017eavati, izradite nominativnu datoteku za razvoj i odr\u017eavanje plana, ograni\u010denu na podatke potrebne za postizanje tog cilja.<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:paragraph -->\n<p>Poslodavac mo\u017ee pristupiti samo odre\u0111enim ograni\u010denim informacijama kako bi poduzeo potrebne organizacijske mjere, dok podatke koji se izravnije odnose na zdravlje mora obra\u0111ivati zdravstveni djelatnik.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>(Na primjer, za produljenje karantene i opravdanje rada na daljinu) i u okviru slu\u017ebi medicine rada:<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Poslodavac nije ovla\u0161ten provoditi dijagnozu zdravstvenog stanja svakog od svojih zaposlenika niti sam upravljati sustavom za procjenu njihove ranjivosti (na primjer putem koda boje).<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Prema va\u017ee\u0107em zakonu, poslodavac ne mo\u017ee provoditi elektroni\u010dko prikupljanje temperature ili putem termovizijske kamere s pohranjivanjem podataka, serolo\u0161ke testove i zdravstvene upitnike. Situacija bi se razlikovala od ru\u010dnog mjerenja temperature bez pohranjivanja podataka: takva praksa ne spada u podru\u010dje primjene GDPR-a, ali mo\u017ee pokrenuti druga pitanja o u\u010dinkovitosti.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Kona\u010dno, i dalje zbog osjetljive prirode obra\u0111enih podataka, najve\u0107a pozornost mora se posvetiti sigurnosnim mjerama koje jam\u010de povjerljivost obra\u0111enih podataka.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Ukratko, glavne mjere koje je poslodavac ovla\u0161ten poduzeti odnose se na organizaciju rada, na temelju podataka ograni\u010denih na rizike izlo\u017eenosti zaposlenika, dok je upravljanje podacima koji se izravnije odnose na bolest izravna odgovornost zdravstvenih djelatnika. Svi ostali zahtjevi poslodavcima za prijavljivanje informacija zdravstvenim vlastima ili za poduzimanje odre\u0111enih mjera mogu se prona\u0107i na web stranici Ministarstva rada.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><strong>\u2022 I tako\u0111er<\/strong><\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><strong>Francuska:<\/strong><\/p>\n<!-- \/wp:paragraph --><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>CNIL je 1. listopada objavio kona\u010dnu verziju svojih smjernica u vezi s kori\u0161tenjem kola\u010di\u0107a i drugih alata za pra\u0107enje.<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:paragraph -->\n<p>Posebno se navodi da se nastavak pregledavanja web stranice ne mo\u017ee smatrati valjanim pristankom na kori\u0161tenje traga\u010da.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Tako\u0111er preporu\u010duje da kontrolori podataka u su\u010delje za prikupljanje privola uklju\u010de ne samo gumb \u201eprihvati sve\u201c ve\u0107 i gumb \u201eodbij sve\u201c.<\/p>\n<!-- \/wp:paragraph --><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Listopad je mjesec kiberneti\u010dke sigurnosti.<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:paragraph -->\n<p>U tom kontekstu, CNIL i ANNSSI objavljuju niz preporuka.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>\u00a0<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Kiberneti\u010dki napadi u posljednjih nekoliko mjeseci posebno su pogodili zdravstveni sektor, industrijski sektor i lokalne vlasti.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Pojedinci su posebno meta ucjene putem web kamere, a CNIL na svojoj web stranici pru\u017ea savjete o tome kako se za\u0161tititi.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p><strong>Europa:<\/strong><\/p>\n<!-- \/wp:paragraph --><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Vije\u0107e Europe objavilo je izvje\u0161\u0107e o otpornosti na\u010dela za\u0161tite podataka u 57 zemalja koje su ratificirale Konvenciju 108, s obzirom na mjere poduzete za suzbijanje pandemije.<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Nadzorno tijelo u Hamburgu kaznilo je H&amp;M s 35 milijuna eura 1. listopada zbog kr\u0161enja privatnosti svojih zaposlenika.<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:paragraph -->\n<p>Tvrtka je prikupljala podatke o godi\u0161njim odmorima, zdravstvenom stanju i vjeroispovijesti svojih zaposlenika.<\/p>\n<!-- \/wp:paragraph --><!-- wp:paragraph -->\n<p>Tvrtka trenutno provodi brojne mjere kako bi osigurala da je obrada u skladu sa zakonom.<\/p>\n<!-- \/wp:paragraph --><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Dva nacrta smjernica dostupna su za javno savjetovanje na mre\u017enim stranicama Europskog odbora za za\u0161titu podataka (EDPB).<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:paragraph -->\n<p>Ti se dokumenti odnose, s jedne strane, na koncepte kontrolora podataka i podizvo\u0111a\u010da, a s druge strane na ciljanje korisnika dru\u0161tvenih mre\u017ea.<\/p>\n<!-- \/wp:paragraph --><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Nakon presude Europskog suda pravde u slu\u010daju Schrems II, kojom se zabranjuje transatlantski prijenos podataka (vidi rujanski uvodnik o ovoj temi), Europska komisija najavila je nove standardne ugovorne klauzule za kraj godine.<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:paragraph -->\n<p><strong>Me\u0111unarodno:<\/strong><\/p>\n<!-- \/wp:paragraph --><!-- wp:list -->\n<ul><!-- wp:list-item -->\n<li>Razvoj prepoznavanja lica poti\u010de raspravu u razli\u010ditim dijelovima svijeta.<\/li>\n<!-- \/wp:list-item --><\/ul>\n<!-- \/wp:list --><!-- wp:paragraph -->\n<p>U Singapuru kori\u0161tenje prepoznavanja lica za pristup javnim uslugama organizacija &quot;Privacy International&quot;
