{"id":14073,"date":"2026-05-06T15:26:58","date_gmt":"2026-05-06T15:26:58","guid":{"rendered":"https:\/\/viqtor.eu\/protection-des-donnees-et-simplification-des-normes-a-quoi-faut-il-sattendre\/"},"modified":"2026-05-06T15:26:58","modified_gmt":"2026-05-06T15:26:58","slug":"protection-des-donnees-et-simplification-des-normes-a-quoi-faut-il-sattendre","status":"publish","type":"post","link":"https:\/\/viqtor.eu\/en\/protection-des-donnees-et-simplification-des-normes-a-quoi-faut-il-sattendre\/","title":{"rendered":"Data protection and simplification of standards: what should we expect?"},"content":{"rendered":"<p><strong>Legal Watch No. 82 \u2013 April 2025.&nbsp; <\/strong><\/p>\n<h3><strong><u>Data protection and simplification of standards: what should we expect?<\/u><\/strong><\/h3>\n<p>The issue of simplifying standards, a recurring topic of discussion in Europe, has taken on particular importance since the change of leadership in the White House.<\/p>\n<p>At the Paris summit on artificial intelligence (AI) last February, competitiveness thus became a stated priority in the face of deregulation in the United States.<\/p>\n<p>The European Commission&#039;s work programme for 2025 also explicitly aims to promote economic growth by supporting innovation.<\/p>\n<p>What will be the impact of this policy on European data protection standards?<\/p>\n<p>In the area of AI, first of all, Europe has committed to achieving the main objectives of the regulation while examining the administrative burden on businesses.<\/p>\n<p>The Commission will seek industry input when regulatory uncertainty is hindering AI development, and will incorporate it into a broader effort to review and possibly remove a set of digital rules by the end of the year.<\/p>\n<p>The AI Liability Directive, which aimed to update EU product safety rules to cover AI and automation, has already been withdrawn.<\/p>\n<p>The CCIA, the main US lobbying group for large technology companies in Brussels, welcomed this approach while calling for a &quot;front-on attack&quot; on the regulation.<\/p>\n<p>The European Commission also informed Member States at the end of April of its draft guidelines concerning the relationship between the AI regulation and other regulations including the GDPR.<\/p>\n<p>She is working on developing a model for the Fundamental Rights Impact Assessments (FRIAs) required by the AI regulation, in order to avoid duplication with the GDPR data protection impact assessment.<\/p>\n<p>For their part, Member States stress the need for enhanced cooperation with other authorities to prevent the two flagship laws from leading to contradictory decisions or overlapping investigations.<\/p>\n<p>The European Data Protection Board (EDPB) is also preparing guidelines on the interaction between the GDPR and the AI regulation, and is examining with the Commission the possibilities for synergies in order to ensure consistency of interpretation, legal certainty and clarity for operators.<\/p>\n<p>What about the GDPR? Last July, the Commission published an evaluation report on the subject, which notably revealed significant frustration among SMEs in several respects:<\/p>\n<ul style=\"list-style-type: square;\">\n<li>Excessive documentation requirements,<\/li>\n<li>Cost of hiring or appointing a DPO,<\/li>\n<li>Difficulties in choosing the legal basis (legitimate interest \/ consent),<\/li>\n<li>Constraints for emerging technologies and startups.<\/li>\n<\/ul>\n<p>This criticism echoes the opinion of former Italian Prime Minister Mario Draghi, whose economic report last September points to Europe&#039;s complex laws that prevent its economy from catching up with the United States and China, and specifically mentions the AI regulation and the GDPR.<\/p>\n<p>The Commission plans to propose a &quot;simplification package&quot; for small and medium-sized enterprises at the end of May, although the date is presented as indicative: the proposal to simplify privacy rules would in any case be delivered by June.<\/p>\n<p>The adjustments could include limiting the requirements for keeping records of data processing activities, or reforming data protection impact assessments \u2013 two rules considered particularly burdensome for SMEs.<\/p>\n<p>It is also worth recalling that MP Axel Voss and the president of the NGO Noyb, Max Schrems \u2013 two figures whose views on the subject have historically been opposed \u2013 joined forces last March to propose a major revision of the GDPR, aimed at<\/p>\n<ul style=\"list-style-type: square;\">\n<li>Simplifying compliance for SMEs and non-profit organizations,<\/li>\n<li>Establish clearer and easier-to-manage rules for large organizations,<\/li>\n<li>Strengthening control capabilities to ensure more effective data protection.<\/li>\n<\/ul>\n<p>While this proposal reflects a shift towards pragmatic solutions that reconcile privacy protection with business realities, others point out the risks of reopening the text which could collapse under lobbying pressure, as highlighted by the digital rights advocacy group EDRi.<\/p>\n<p>It is worth remembering that the negotiations concerning the development of the GDPR triggered one of the biggest lobbying efforts Brussels has ever seen.<\/p>\n<p>Technology companies spent millions trying to influence the rules during the drafting process and the proposal had been subject to more than 3,000 amendments in the European Parliament, a record.<\/p>\n<p>Current work on the GDPR procedural regulation, which aims to strengthen cooperation between data protection authorities (DPAs) and accelerate decision-making in cross-border cases, may well confirm that the road to hell is paved with good intentions.<\/p>\n<p>As discussions (trilogue) between the Commission, the European Parliament and the Council continue, some warn of the risk of producing a compromise that not only fails to deliver the necessary reforms, but could also introduce new vulnerabilities.<\/p>\n<p>On April 17, the NGO Noyb stated that the Trilogue has led to legislative chaos that will likely make procedures more complex, slower, and subject to legal challenge.<\/p>\n<h4><strong>&nbsp;<\/strong><\/h4>\n<h4><strong><img decoding=\"async\" src=\"https:\/\/viqtor.eu\/wp-content\/uploads\/2026\/05\/france_1773309258549.jpg\" alt=\"\" width=\"145\" height=\"97\"> &nbsp; &nbsp;&nbsp;<\/strong><\/h4>\n<p><strong>The CNIL published its annual report for 2024 on April 29. <\/strong><\/p>\n<p>Key themes include cybersecurity, which is becoming a strategic priority for the coming years with a notable increase in data breaches (+20 %), and the strengthening of repressive actions.<\/p>\n<p>The report also emphasizes the importance of respecting the rights of minors, controlling commercial prospecting practices and regulating video surveillance.<\/p>\n<p>In parallel, the CNIL is strengthening its European cooperation to better regulate large digital platforms and is continuing its work on AI.<\/p>\n<p><strong>The Commission also published its guidelines on April 30 to strengthen the security of large databases. <\/strong><\/p>\n<p>These measures extend and reinforce basic safety precautions.<\/p>\n<p>Like the priority cyber measures of ANSSI or those aimed at preventing data leaks, they do not aim to list all the sufficient measures, but draw the attention of data controllers to security measures that the CNIL considers required when large databases are involved, particularly with regard to the risks of massive data exfiltration.<\/p>\n<p>Two hundred French media outlets are filing a complaint against Meta for &quot;illegal practices&quot;: according to Le Monde, &quot;several press groups (Prisma, Les Echos-Le Parisien, CMI), national and regional dailies as well as private and public broadcasters (TF1, RMC-BFM, France T\u00e9l\u00e9visions and Radio France) accuse Meta of having taken advantage of the period when they themselves were implementing user consent for the collection of their personal information to engage in targeted advertising.&quot;<\/p>\n<h4>&nbsp;<\/h4>\n<h4><img decoding=\"async\" src=\"https:\/\/viqtor.eu\/wp-content\/uploads\/2026\/05\/Europe_1773309231938.jpg\" alt=\"\" width=\"145\" height=\"97\"><\/h4>\n<h4><strong>European institutions and bodies <\/strong><\/h4>\n<p><strong>On April 23, the European Commission issued its first two fines under the Digital Markets Regulation (DMA). <\/strong><\/p>\n<p>More specifically, Apple and Meta were fined \u20ac500 million and \u20ac200 million respectively.<\/p>\n<p>The Commission believes that Apple has not complied with its obligations regarding the availability of applications on the App Store.<\/p>\n<p>As for Meta, the company has been fined 200 million euros because of its &quot;consent or pay&quot; system.<\/p>\n<p>The Commission considered that this model did not give users the specific choice of opting for an equivalent service that would use less personal data.<\/p>\n<p>Note that since this investigation, Meta has introduced a third option, that of &quot;less personalized ads&quot;, which has not yet been evaluated by the Commission.<\/p>\n<p>The Commission has published four new calls for tenders worth \u20ac140 million under the Digital Europe (DIGITAL) programme to advance the deployment of AI, promote advanced digital skills, expand the network of European Digital Innovation Hubs (EDIH) and combat disinformation.<\/p>\n<p>In this context, it published a call for contributions on April 9 concerning future legislation on cloud and AI (Cloud and AI Development Act \u2013 CAIDA).<\/p>\n<p>The objective would be to address the lack of a competitive European cloud services offering at a sufficient scale for highly critical uses with particularly high security requirements.<\/p>\n<p><strong>The EDPB and EDPS presented their 2024 annual reports at the end of April. <\/strong><\/p>\n<p>The EDPS highlighted the evolution of its role in light of the European AI regulation, which mandates it to be the supervisory and notification authority for EU institutions.<\/p>\n<p>The EDPB report provides an overview of the work carried out in 2024, including the adoption of the 2024-2027 strategy, the increase in opinions under the consistency mechanism pursuant to Article 64(2), and ongoing efforts to provide guidance and legal advice, particularly to SMEs.<\/p>\n<p><strong>At its plenary session in April 2025, the EDPB adopted guidelines on the processing of personal data through blockchain technologies. <\/strong><\/p>\n<p>The document emphasizes the importance of implementing technical and organizational measures from the earliest stages of processing design and of defining at the same time the roles and responsibilities of the various actors in the processing.<\/p>\n<p>It reiterates the importance of data protection impact assessments and provides examples of data minimization techniques, as well as the processing and storage of personal data. The guidelines are open for consultation until June 9.<\/p>\n<p>Regarding access to administrative documents, the Court of Justice of the European Union (CJEU) has adopted a judgment concerning the balance to be found between this right and the protection of the data of persons mentioned in these documents.<\/p>\n<p>It held that Article 6(1)(c) and (e) of the GDPR do not preclude additional information obligations and consultation of the data subject before any disclosure of personal data concerning him or her.<\/p>\n<p>However, these additional obligations must not have the effect of disproportionately restricting public access to these documents.<\/p>\n<p><strong>The CJEU publishes an update to its thematic sheet on its most important rulings in the field of data protection. <\/strong><\/p>\n<p>The document covers case law relating to general data protection regulations and sector-specific regulations (electronic communications and criminal law). It also presents a selection of judgments concerning cross-cutting regulations, while highlighting the role of the Charter in the development of case law.<\/p>\n<p>European users of the Meta platforms received a notification in April informing them of the use by Facebook and Instagram of their data for AI training purposes, along with a link to an objection form.<\/p>\n<p>The Norwegian Data Protection Authority (APD) published a blog post explaining the consequences of this decision and the legal recourse available to individuals. It also stated that it had asked Meta, along with other APDs, whether it had examined the compatibility of AI training with the original objective of collecting users&#039; messages and images.<\/p>\n<p>The International Association of Privacy Professionals (IAPP) publishes a table offering an overview of the requirements for notification of digital security incidents and information sharing in several European legislations.<\/p>\n<p>It takes into consideration the GDPR, the &quot;police&quot; directive, the ePrivacy directive, the data governance regulation, the data regulation, the NIS2 directive, the digital operational resilience regulation, the Payment Services Directive 2, the cyber-resilience regulation and the AI regulation.<\/p>\n<p>Microsoft has officially implemented its European data boundary principle for cloud services, committing to store and process its customers&#039; personal data exclusively within the EU and EFTA.<\/p>\n<p>Data from certain Azure services may nevertheless be transferred outside the EU if Microsoft deems it necessary for cybersecurity investigations.<\/p>\n<p>Furthermore, it should be noted that the Cloud Act allows US authorities to access the data of American companies regardless of where it is stored.<\/p>\n<h4>&nbsp;<\/h4>\n<h4><strong>News from the member countries of the European Union. <\/strong><\/h4>\n<p><strong>The German Federal Court of Justice<\/strong> considered that qualified entities (such as consumer organisations) are entitled to bring legal action for breach of GDPR information obligations under consumer protection law, regardless of the specific breach and without a mandate from the data subjects.<\/p>\n<p>The case concerned Meta Platforms Ireland Ltd (Meta)&#039;s failure to comply with legal requirements relating to obtaining user consent.<\/p>\n<p><strong>In Belgium<\/strong>A decision recalls that the scope of the GDPR extends to professional data: the APD imposed a fine of 20,000 euros on a business-to-business data broker for having collected and disclosed the email address of the managing partner of a company.<\/p>\n<p>The APD also recalled that a data controller cannot force an individual to create an online account if it is not necessary, in this case to file a complaint.<\/p>\n<p>The company has here violated the principles of data minimization and data protection by default and by design.<\/p>\n<p><strong>In Spain,<\/strong> A company (Marina Salud) managing hospital data on behalf of the autonomous government of the Valencian Community has been fined 500,000 euros after appointing secondary subcontractors without the authorization of the data controller, in violation of Article 28(2) of the GDPR.<\/p>\n<p>Also in Spain, a bank was fined 120,000 euros for the unlawful processing of a customer&#039;s personal data in violation of Article 6(1) of the GDPR, following the imitation of the customer&#039;s signature by an employee on a data protection agreement.<\/p>\n<p>TikTok was condemned on May 2nd by <strong>Irish DPA<\/strong> to a fine of 530 million euros for illegally sending personal data of Europeans to China and concealing it from its users.<\/p>\n<p>TikTok has six months to bring its practices into compliance with the GDPR.<\/p>\n<p>An Irish court has upheld the decision of the Data Protection Authority (DPA) which had determined that an employer was not the data controller with regard to non-professional data contained in the work phone of one of its employees.<\/p>\n<p><strong>The Maltese APD<\/strong> publishes a series of FAQs on managing employee email accounts when they leave their organization.<\/p>\n<p>The guide encourages employers to adopt a proactive and structured approach to account management, both during the employment relationship and after the employee&#039;s departure, and to address key questions regarding common practices such as automatic mail forwarding and automatic reply messages.<\/p>\n<p>In the context of the presidential elections held in Romania on May 4 and 18, TikTok announced new measures aimed at preventing a disinformation campaign comparable to the one that allegedly helped propel candidate C\u0103lin Georgescu to the top of the first round last November.<\/p>\n<p>The application has also launched an &quot;Elections Centre&quot;, which presents information such as important dates and links to the website of the Permanent Electoral Authority, and published awareness tools regarding disinformation.<\/p>\n<p>These measures are being taken as the European Commission has launched an investigation under the Digital Services Act (DSA) to shed light on the events of November.<\/p>\n<h4><strong>&nbsp;<\/strong><\/h4>\n<h4><strong><img decoding=\"async\" src=\"https:\/\/viqtor.eu\/wp-content\/uploads\/2026\/05\/INTERNATIO_1773309177334.jpg\" alt=\"\" width=\"150\" height=\"85\"><\/strong><\/h4>\n<p>In China, the Cyberspace Administration has just announced the launch of a three-month campaign to combat the misuse of AI technologies. Departments responsible for internet regulation will be required to guide online platforms to meet the campaign&#039;s requirements by strengthening mechanisms for reviewing AI-generated content, improving detection capabilities, and ensuring the proper implementation of corrective measures.<\/p>\n<p>In the United States, members of the House Energy and Commerce Committee have launched an investigation into Deepseek&#039;s ties to the Chinese Communist Party. The chatbot is alleged not only to send data to China but also to share users&#039; personal information with other party-linked entities, including ByteDance Ltd. The AI application is also suspected of collecting its users&#039; heart rate data.<\/p>\n<p>The Future of Privacy Forum (FPF) is under fire from the Trump administration. Senate Commerce Committee Chairman Ted Cruz (R-Texas) is demanding answers from the FPF, which allegedly used federal grants to pressure states into adopting &quot;left-wing&quot; AI laws. Senator Cruz is concerned that the group is openly advocating for AI regulations aligned with the Biden administration&#039;s political agenda. He is also scrutinizing the federal grants awarded to the organization.<\/p>\n<p>According to Euractiv, which cites information from the Financial Times, the European Commission is equipping its staff sent to the United States with disposable phones due to surveillance concerns. &quot;The new guidelines issued by the EU executive, which also recommend the use of basic laptops when traveling to the US, are similar to those for travel to Ukraine or China. All staff are advised to switch off their devices and place them in a dedicated anti-spy pouch upon entering the country.&quot;<\/p>\n<p>CNN reports that the Trump administration, with the help of Palantir, is establishing a &quot;general database to expedite immigration enforcement and deportation by combining sensitive data from across the federal government,&quot; creating &quot;targeting lists,&quot; and arresting targeted individuals.
