{"id":14042,"date":"2026-05-06T15:25:01","date_gmt":"2026-05-06T15:25:01","guid":{"rendered":"https:\/\/viqtor.eu\/lintelligence-artificielle-comme-outil-de-travail-quel-encadrement\/"},"modified":"2026-05-06T15:25:01","modified_gmt":"2026-05-06T15:25:01","slug":"lintelligence-artificielle-comme-outil-de-travail-quel-encadrement","status":"publish","type":"post","link":"https:\/\/viqtor.eu\/en\/artificial-intelligence-as-a-work-tool-what-framework-is-needed\/","title":{"rendered":"Artificial intelligence as a work tool: what kind of framework is needed?"},"content":{"rendered":"<p><strong>Legal Watch No. 77 \u2013 November 2024.&nbsp; <\/strong><\/p>\n<h3><strong><u>Artificial intelligence as a work tool: what kind of framework is needed?<\/u><\/strong><\/h3>\n<p>The use of AI in the workplace is exploding today, often without prior thought and without the employer knowing exactly how their employees are using the new tools at their disposal.<\/p>\n<p>Whether it&#039;s the now classic language models such as ChatGPT, or tools that allow you to create a graphic design (Canva), extract data from the web (Browse AI) or automatically take notes during a meeting (Fireflies), the possibilities are legion.<\/p>\n<p>According to an IFOP study for Learnthings dating from December 2023, almost one in four employees has already used an artificial intelligence tool in a professional context and among them, more than half (55 %) did so without informing their manager.<\/p>\n<p>However, understanding how these tools are used internally is essential to ensure compliance with the applicable legal framework, and in particular with the European regulation on AI and the GDPR.<\/p>\n<p>Several authorities, including ANSSI and CNIL, have published recommendations aimed at raising awareness among professional users. Here are the main points:<\/p>\n<p><strong>Implementing an AI charter<\/strong> within the company in order to<\/p>\n<ul style=\"list-style-type: square;\">\n<li>List the allowed tools;<\/li>\n<li>Map these tools according to the risks, in compliance with the AI regulation;<\/li>\n<li>Regulating high-risk systems (e.g., vocational training and HR recruitment, where the use of AI risks generating &quot;automation of discrimination&quot;).<\/li>\n<\/ul>\n<p><strong>Organize a social dialogue<\/strong>, consult the CSE and amend the internal work rules in order to make these rules enforceable internally.<\/p>\n<p><strong>Ensuring data security<\/strong> Providing personal data to an AI system (e.g., customer or employee data), or sensitive or strategic documentation, can have significant consequences in terms of confidentiality.<\/p>\n<p>Furthermore, the use of such a system can impact the integrity of the information system to which it is connected.<\/p>\n<p>The CNIL advises prioritizing the deployment of &quot;on-site&quot; solutions that limit the risks of data extraction from a third party.<\/p>\n<p>While it may be more economical to use a cloud-hosted system, it will be necessary to have a subcontracting agreement specifying the different responsibilities and authorized access to the processed data.&nbsp;<\/p>\n<p>In this case, it is recommended to limit the provision of personal data to the AI system.<\/p>\n<p><strong>To train and raise awareness<\/strong> end users should follow these best practices:<\/p>\n<ul style=\"list-style-type: square;\">\n<li>Provide only data that you are authorized to share, excluding in principle any confidential data;<\/li>\n<li>Verify the accuracy and quality of the data generated by the system, the absence of plagiarism and the risk of discrimination;<\/li>\n<li>Do not reproduce the system outputs exactly as they are in order to maintain a critical perspective.<\/li>\n<\/ul>\n<p><strong>Ensuring transparency in processing<\/strong>, in particular those that generate automated decisions regarding employees and third parties outside the company.<\/p>\n<p><strong>Establish governance<\/strong> : designate the DPO, a committee or a referent (also involving the CISO) in order to offer end users a point of contact to raise ethical issues or difficulties and verify compliance with the rules.<\/p>\n<p>In addition to the sanctions provided for by the GDPR and the AI regulation, the adoption of a clear framework also represents a social and ethical issue, in the interest of both people external to and internal to the company.<\/p>\n<h4>&nbsp;<\/h4>\n<h4><strong><img decoding=\"async\" src=\"https:\/\/viqtor.eu\/wp-content\/uploads\/2026\/05\/france_1773239943859.jpg\" alt=\"\" width=\"145\" height=\"97\"> &nbsp; &nbsp; &nbsp; &nbsp;&nbsp;<\/strong><\/h4>\n<p>The CNIL publishes an action plan to support the players in the Silver Economy, a sector dedicated to activities benefiting seniors.<\/p>\n<p>She points out that seniors will represent approximately 24 million people in France by 2060 and that &quot;the nature of the data processed and the targeting based on age raises significant issues regarding data protection.&quot;<\/p>\n<p>It intends to update its compliance pack (fact sheets, recommendations, etc.) and is proposing a new &quot;sandbox&quot; to support three innovative projects in this sector.<\/p>\n<p>On November 18, the CNIL and the DGCCRF announced the signing of a new cooperation protocol updating the 2011 agreement.<\/p>\n<p>The two authorities are strengthening their collaboration and developing new avenues for information sharing to adapt to changes in legislation and the economic challenges of the digital age.<\/p>\n<p>In a publication dated November 19, the CNIL also reiterates the data protection principles applicable to the use of augmented cameras in the passenger compartment of goods transport vehicles, and insists that the employer must take all necessary measures to ensure the compliance of such cameras before their installation.<\/p>\n<p>On November 25, the CNIL published a series of tips to protect your data when interacting with a voice assistant.<\/p>\n<p>An employee who implements orders that violate the GDPR exposes himself to criminal liability, even if he is acting under instructions from his employer.<\/p>\n<p>At the Nantes criminal court, the public prosecutor has just requested a fine of 6,000 euros, of which 3,000 euros are suspended, against an employee of an IT subcontracting company, for having installed a spy device at his clients&#039; premises on the orders of his boss.<\/p>\n<p>The prosecutor is requesting a 9-month suspended prison sentence and a \u20ac30,000 fine for the boss.<\/p>\n<p>In a ruling issued on November 21, 2024, the Paris Court of Appeal upheld the judgment issued on July 23, 2021 by the Meaux Industrial Tribunal: a private conversation on Messenger, initially not intended to be made public, cannot be considered a breach of an employee&#039;s contractual obligations and disciplinary dismissal based on such grounds cannot be legitimately justified.<\/p>\n<p>The Court relies on a ruling by the Court of Cassation dated December 22, 2023 on the same subject.<\/p>\n<p>This reasoning applies even if, as in the present case, the employer had not sought to access this information: during the absence of an employee, he had asked her to transmit her identifiers to allow her colleagues to access her professional documents, and the messages had appeared when the conversation automatically opened on the screen.<\/p>\n<h4>&nbsp;<\/h4>\n<h4><img decoding=\"async\" src=\"https:\/\/viqtor.eu\/wp-content\/uploads\/2026\/05\/Europe_1773239971405.jpg\" alt=\"\" width=\"145\" height=\"97\"><\/h4>\n<h4><strong>European institutions and bodies <\/strong><\/h4>\n<p>The European Data Protection Board (EDPB) is launching a call for comments on its guidelines relating to Article 48 of the GDPR.<\/p>\n<p>The guidelines relate to requests for direct cooperation between a public authority of a third country (such as banking regulators, tax authorities, law enforcement or national security) and a private entity of the European Union (EU).<\/p>\n<p>Comments can be submitted until January 27, 2025.<\/p>\n<p>The EDPB also adopted a statement in early December concerning the European Commission&#039;s second report on the application of the GDPR, in which it underlines the importance of consistency between digital legislation and the GDPR.<\/p>\n<p>The EDPB will intensify the production of content for non-experts, including small and medium-sized enterprises, and underlines the need for additional financial and human resources to help data protection authorities (DPAs) cope with increasingly complex challenges and additional skills, including in AI.<\/p>\n<p>The victory of the anti-EU opposition candidate in the first round of the Romanian presidential election on November 24 has repercussions at the European level.<\/p>\n<p>While the country&#039;s Constitutional Court has just annulled this first round following the declassification of national intelligence documents revealing a large-scale operation on TikTok in favor of this candidate, the European Commission launched on November 29 an official request for information from the company under the Digital Services Act (DSA).<\/p>\n<p>On November 28, the Council of Europe&#039;s AI Committee adopted a methodology (HUDERIA) for assessing the risks and impacts of AI systems from the perspective of human rights, democracy and the rule of law.<\/p>\n<p>This methodology can be used by public and private actors to help identify and address these risks and impacts throughout the lifecycle of AI systems.<\/p>\n<p>In mid-November, the Digital Freedom Fund published, as part of the digiRISE project, a comprehensive database on collective redress in Europe, designed to promote collective action in the defense of digital rights under the EU Charter of Fundamental Rights.<\/p>\n<p>The document includes resources on how ten EU Member States have implemented collective redress mechanisms: national reports, a comparative report and a comparative tool to discover convergences and differences between the jurisdictions studied are available.<\/p>\n<p>In the area of collective redress as well, the NGO NOyB indicates that it is now approved as a &quot;qualified entity&quot; to bring collective redress actions before EU courts.<\/p>\n<p>Such action under Directive (EU) 2020\/1828 may be an &quot;injunction&quot; or a &quot;remedial&quot; measure.<\/p>\n<p>These laws allow thousands of users to be represented and to claim, for example, non-material damages when their personal data has been processed unlawfully.<\/p>\n<p>Unlike American class action lawsuits, European legislation requires that these actions be brought for non-profit purposes.<\/p>\n<p>Meta is once again revising its plans for the distribution of personalized advertisements in the European Union.<\/p>\n<p>This change stems from the position of EU regulators, who considered that the &quot;consent or pay&quot; advertising system offered to European users of Facebook and Instagram violated the GDPR and the Digital Markets Regulation (DMA).<\/p>\n<p>The new offer includes an ad-free subscription at a reduced cost, and also introduces a free model characterized by the delivery of &quot;less personalized ads&quot; with consent.<\/p>\n<p>Max Schrems, who initiated several actions against Meta, stated that &quot;overall, this looks like another attempt to ignore European legislation (...) users must have a real choice between advertisements that use their personal data and those that do not.&quot;<\/p>\n<h4>&nbsp;<\/h4>\n<h4><strong>News from the member countries of the European Union. <\/strong><\/h4>\n<p>In Germany, the Federal Court of Justice (Bundesgerichtshof, BGH) partially overturned a decision by the Cologne Higher Regional Court which considered a claim for moral damages to be insufficiently reasoned.<\/p>\n<p>The case involved a data breach: in April 2021, the data of approximately 533 million Facebook users was made public on the Internet.<\/p>\n<p>The BGH stressed that, according to the case law of the Court of Justice of the EU, even a single and temporary loss of control over data can constitute non-pecuniary damage under Article 82(1) of the GDPR.<\/p>\n<p>The person concerned does not need to demonstrate a concrete misuse of their personal data.<\/p>\n<p>An Austrian court ruled that a divorce lawyer could justify sending video material showing the person&#039;s extramarital affair to the opposing party&#039;s lawyer by email on the basis of legitimate interest under Article 6(1)(f) and 9(2)(f) of the GDPR.<\/p>\n<p>Another court, however, considered that the interest of one spouse not to be recorded during marital disputes at their home outweighed the interest of the other spouse in using those recordings in divorce proceedings.<\/p>\n<p>In Belgium, the APD sanctioned the use of identity cards as loyalty cards on November 28: it found that the company Freedelity, a company specializing in the collection of data via electronic identity cards (eID), had violated several articles of the GDPR concerning the validity of consent, the minimization of collection and the duration of data retention.<\/p>\n<p>Freedelity collects eID data, notably via terminals placed in partner stores.<\/p>\n<p>This data is then shared and synchronized with stores using its services in the event of an update.<\/p>\n<p>In Spain, The Phone House SL was fined 6,500,000 euros by the APD for taking inadequate security measures that allowed a ransomware attack.<\/p>\n<p>The attack affected approximately 13 million customers, exposing addresses, telephone numbers, identity documents and banking data.<\/p>\n<p>Posti, the Finnish postal service, was fined 2,400,000 euros on November 13 for allocating email accounts to its customers without their explicit consent.<\/p>\n<p>Customers requesting services such as mail forwarding were automatically assigned an email account with no option to opt out.<\/p>\n<p>The Italian Data Protection Authority (APD) adopted a decision on November 27 concerning a licensing agreement between OpenAI and the publishing company GEDI.<\/p>\n<p>The APD opposes the use of legitimate interest as a legal basis for the processing of personal data for AI training purposes, whether or not the processing involves sensitive data.<\/p>\n<p>According to the APD, licensing agreements concerning editorial content used for AI training should guarantee, in the absence of consent, the deletion or anonymization of all personal data used.<\/p>\n<p>This decision comes a few weeks before the EDPB&#039;s opinion on this issue, expected at the end of December.<\/p>\n<p>The Italian Data Protection Authority (APD) also fined the food delivery company Foodinho, a subsidiary of the Glovo group, \u20ac5,000,000 due to numerous and ongoing violations of the GDPR related to the processing of its employees&#039; data, including the continuous tracking of their geolocation and the automated assignment of shifts.<\/p>\n<p>On November 11, the Dutch Data Protection Authority (DPA) published a report finding that an algorithm used by the Education Executive Agency to combat fraud was discriminatory and illegal.<\/p>\n<p>The agency used this algorithm to check if students were abusing the scholarship for non-residents.<\/p>\n<p>A &quot;risk score&quot; was assigned to students taking into account the type of education, age, and distance between the student&#039;s address and that of their parents.<\/p>\n<p>These criteria had no objective justification and the Minister of Education, Culture and Science responsible for the agency finally conceded that the algorithm was indirectly discriminatory towards students from immigrant backgrounds.<\/p>\n<p>In Poland, the APD fined a data controller 353,589 PLN (\u20ac82,000) for insufficient security measures that allowed a ransomware attack.<\/p>\n<p>The hackers had encrypted and rendered inaccessible the data of approximately 200 customers and employees. A subcontractor involved was fined 9,822 PLN (\u20ac2,200).<\/p>\n<h4>&nbsp;<\/h4>\n<h4><strong><img decoding=\"async\" src=\"https:\/\/viqtor.eu\/wp-content\/uploads\/2026\/05\/shutterstock_2614166247_1773240025608.jpg\" alt=\"\" width=\"150\" height=\"85\"><\/strong><\/h4>\n<p>In late November, the Australian Senate passed a bill amending privacy legislation which contains several major changes:<\/p>\n<ul style=\"list-style-type: square;\">\n<li>The introduction of a civil offense for serious breaches of privacy.<\/li>\n<li>The expansion of the enforcement and investigative powers available to the APD.<\/li>\n<li>The power for this to develop an online privacy code for children.<\/li>\n<li>A new opportunity for the Governor-General to establish a &quot;white list&quot; of countries offering adequate data protection.<\/li>\n<li>The obligation for data protection policies to detail automated decision-making systems that may affect an individual&#039;s rights or interests.<\/li>\n<\/ul>\n<p>In Australia too, parliament passed a controversial law on November 29th banning access to social media for children and teenagers under the age of 16.<\/p>\n<p>The law does not specify how platforms will have to verify the age of their visitors.<\/p>\n<p>Brazil&#039;s Data Protection Agency (APD) publishes a report on generative AI and data protection.<\/p>\n<p>Originally developed for internal support of the APD teams, the document addresses the concepts of AI, its relationship with data protection, the Brazilian context and the prospects for AI.<\/p>\n<p>On December 3, the United States Federal Trade Commission (FTC) announced the conclusion of draft agreements aimed at prohibiting two major data brokers, Mobilewalla and Gravy Analytics, from selling sensitive location data, including, for example, attendance at churches, military bases, medical offices or LGBTQ bars.<\/p>\n<p>This measure follows on from actions taken earlier this year against data brokers who engage in similar practices.<\/p>\n<p>After the Chamber of Deputies, the Mexican Senate approved at the end of November a draft constitutional law providing for the elimination of seven control authorities, including the data protection and access to administrative documents authority (INAI).<\/p>\n<p>The powers of these authorities would be absorbed by different ministries.<\/p>\n<p>Those from INAI would be taken over by the Ministry of the Fight Against Corruption and Good Governance.<\/p>\n<p>Commentators believe that ratification of the bill by a majority of the legislative assemblies of Mexican states should happen quickly, as has happened with other reform proposals in recent months.<\/p>","protected":false},"excerpt":{"rendered":"<p>Legal Watch No. 77 \u2013 November 2024.
