Smart cameras and biometrics \u2013 what will be the impact of the law relating to the Olympic Games?<\/u><\/strong><\/h4>\n

On March 23, the National Assembly adopted Article 7 of the law on the Olympic Games.<\/p>\n

The bill, passed in a sparsely attended assembly (73 out of 577 members were present), has already generated a lot of discussion, and will certainly provoke many more reactions in the coming months.<\/p>\n

It effectively legalizes the use of algorithmic surveillance until December 2024, in a context described as exceptional but for events that go beyond the strict framework of the Olympic Games.<\/p>\n

Surveillance may concern "sporting, recreational or cultural events" in general, "exposed to risks of terrorist acts or serious threats to the safety of persons".<\/p>\n

It can therefore be tested at sporting events such as this autumn's Rugby World Cup.<\/p>\n

 <\/p>\n

What is algorithmic surveillance? Is it a form of biometric surveillance subject to the strict obligations of the GDPR and the future European regulation on artificial intelligence?<\/strong><\/p>\n

The project plans to use AI-assisted "augmented cameras" piloted by drones, which will be used to automatically analyze images in real time by algorithms to detect predetermined events, such as crowd movements, luggage, gestures or suspicious behavior.<\/p>\n

While highlighting the major issues of augmented cameras in terms of privacy and protection of personal data, the CNIL in its observations of December 8 did not seem to consider that biometric processing would be at work.<\/p>\n

She noted that several measures were in line with her recommendations:<\/p>\n

    \n
  • Experimental deployment, limited in time and space, for certain specific purposes and corresponding to serious risks to people,<\/li>\n
  • Lack of biometric data processing and cross-referencing with other files, and<\/li>\n
  • Decisions subject to prior human intervention.<\/li>\n<\/ul>\n

    For civil society, however, the technology used clearly falls under the category of biometrics.<\/p>\n

    Indeed, it "constantly identifies, analyzes, and classifies bodies, physical attributes, gestures, silhouettes, and gaits, which are undeniably biometric data."<\/p>\n

    La Quadrature du Net and some forty international organisations have developed this perspective in an open letter to the National Assembly coordinated and published by the ECNL (European Centre for Non-Profit Law).<\/p>\n

    The GDPR defines biometric data as "personal data resulting from specific technical processing relating to the physical, physiological or behavioural characteristics of a natural person, which enable or confirm his or her unique identification" (Article 4.14).<\/p>\n

    The open letter notes that cameras will inevitably capture and analyze physiological traits and behaviors of people present in monitored public spaces, and that isolating these people from their environment, which proves essential to fulfilling the system's objective, constitutes a "unique identification".<\/p>\n

    According to the GDPR and the interpretation of the European Data Protection Board on this subject, the ability to isolate a person from a crowd or from their environment, whether their name or identity is known or not, constitutes a "unique identifier".<\/p>\n

    Placing people in a category grouping "at-risk" behaviors based on this data would thus constitute a biometric categorization likely to be in contradiction with the provisions of the future European regulation on artificial intelligence.<\/p>\n

    In this regard, we should note the opinion of June 18, 2021 from European data protection regulators, which calls for a general ban on any use of AI for the automatic recognition of human characteristics in publicly accessible spaces.<\/p>\n

    These arguments are also included in a letter sent to the National Assembly by 41 members of the European Parliament who stress that with this law France would become the first country in Europe to legalize mass surveillance of its public space.<\/p>\n

    The legislation may therefore have to pass a test of compatibility with European law.<\/p>\n

    It should be noted in this regard that the draft Regulation on artificial intelligence is on the agenda of the plenary session of the European Parliament for the end of May.<\/p>\n

    CNIL    <\/strong><\/h4>\n

     <\/strong>The CNIL has published its list of priority control themes <\/strong>For 2023: this year she will focus on:<\/p>\n

      \n
    • The use of "augmented" cameras by public actors,<\/li>\n
    • The use of the consumer credit incident file,<\/li>\n
    • The management of patient health records and<\/li>\n
    • Mobile applications.<\/li>\n<\/ul>\n

      She also published her first thematic dossier at the end of March concerning digital identity<\/strong>, presenting the key principles and its positions on the subject.<\/p>\n

      The dossier is intended for the general public as well as public or private organizations and researchers.<\/p>\n

      In this regard, it is worth recalling that in a publication dated February 22, the CNIL reviewed the experiment conducted since 2019 on the electronic health insurance card (\u201ce-carte Vitale\u201d) which will be offered on an optional basis to all social security beneficiaries before the end of 2025.<\/p>\n

      Beyond its everyday use, the "e-Carte Vitale" will be an alternative to FranceConnect for the digital health sector.<\/p>\n

      On March 16, 2023, the CNIL imposed a fine of 125,000 euros on the company CITYSCOOT<\/strong>.<\/p>\n

      The CNIL found that the company was geolocating its customers almost permanently when renting a scooter and was retaining this data.<\/p>\n

      The Commission also noted that the subcontracting agreements did not include certain essential clauses, including the nature of the data collected, the security measures to be put in place, and the fate of the data in the event of termination of the contracts.<\/p>\n

      The company also used a reCAPTCHA mechanism that transmitted the collected data to GOOGLE for analysis, without providing any information to the user and without obtaining their prior consent.<\/p>\n

      European institutions and bodies<\/em><\/strong><\/h4>\n

      EDPB<\/strong><\/h4>\n

      The European Data Protection Board (EDPB) has launched its coordinated annual inspection action.<\/p>\n

      Over the next few months, 26 national data protection authorities from the EEA will participate in this action concerning the designation and position of data protection officers.<\/p>\n

      The investigations will aim to establish whether the delegates have a position that complies with the requirements of Articles 37 to 39 of the GDPR and the resources necessary to carry out their tasks.<\/p>\n

      Questionnaires will be sent to them in order to map their situation and determine if a formal investigation is justified.<\/p>\n

      DSA<\/strong><\/h4>\n

      Under the Digital Services Regulation (DSA), the European Union has set new rules requiring very large online platforms (Very Large Online Platforms and Very Large Search Engines) with more than 45 million users to register with the European Commission before February 17.<\/p>\n

      According to an analysis by a professor at the London School of Economics and Political Science, 18 actors would be involved: AliExpress, Amazon marketplace, Apple App store, Booking.com, Facebook, Google Maps, Google Play, Google Shopping, Instagram, LinkedIn, Pinterest, Snapchat, TikTok, Twitter, YouTube, Wikipedia, Bing search and Google search.<\/p>\n

      TikTok<\/strong><\/h4>\n

      The social network TikTok announced in mid-February its intention to comply with the DSA, which will come into effect in mid-2023.<\/p>\n

      TikTok also announced the deployment of data centers in Europe in order to limit cross-border data flows.<\/p>\n

      This announcement comes as EU institutions, as well as the governments of the Netherlands, Canada and the White House in the United States, have recently asked their employees to uninstall the application from their professional and personal equipment, citing personal data protection concerns.<\/p>\n

      DMA<\/strong><\/h4>\n

      At the end of March, the European Commission set up a high-level group to ensure consistent application of the Digital Markets Regulation (DMA) with other European regulations.<\/p>\n

      Among those appointed are the European Data Protection Supervisor (EDPS) and the European Data Protection Board (EDPB).<\/p>\n

      The Digital Markets Act applies specifically to large online platforms designated as "gatekeepers".<\/p>\n

      ENISA <\/strong><\/h4>\n

      The European agency ENISA is publishing a study on cybersecurity threats to 2030 on March 29.<\/p>\n

      This study aims to identify and collect information on future threats that could affect the Union's infrastructure and services, as well as its ability to ensure the digital security of European society and citizens.<\/p>\n

      ENISA also publishes a report on AI cybersecurity and standardization.<\/p>\n

      The objective of the document is to provide an overview of existing and future standards, to assess their scope and to identify gaps in standardisation.<\/p>\n

      It takes into account the specificities of AI, and in particular machine learning, and adopts a broad vision of cybersecurity, encompassing the requirements of confidentiality, integrity and availability, and the broader concept of AI reliability.<\/p>\n

      Finally, the report examines how standardisation can support the implementation of cybersecurity aspects integrated into the proposed EU regulation on AI.<\/p>\n

      EUROPEAN COMMISSION<\/strong><\/h4>\n

      On March 6, the European Commission announced that, following a dialogue involving EU consumer protection authorities, WhatsApp has committed to being more transparent about changes to its terms of service.<\/p>\n

      The company will also make it easier for users to reject updates when they disagree with them, and will explain when such a rejection leads to the user no longer being able to use its services.<\/p>\n

      WhatsApp has also confirmed that users' personal data is not shared with third parties or other Meta companies for advertising purposes.<\/p>\n

      IAPP<\/strong><\/h4>\n

      The IAPP website features a table ("EU data initiatives in context") listing European data protection regulations and ongoing initiatives, from the GDPR and the DSA to the European cybersecurity strategy. This list was updated in March 2023.<\/p>\n

      National news<\/em><\/strong><\/h3>\n

      • UNITED KINGDOM : <\/strong>On Thursday, March 9, the British government presented a "softened" draft law on data protection and digital information to Parliament. The proposed reform would notably allow companies to collect data more easily without the consent of their users, for example, as part of their research and development policies.<\/li>\n<\/ul>\n

        The obligations regarding consent for the placement of cookies will also be eased, and the recruitment of an internal data protection officer will no longer be mandatory.<\/p>\n

        Still in the United Kingdom:<\/p>\n

          \n
        • The National Cyber Security Centre has published an article assessing the risks and making recommendations for the use of LLMs (Large Language Models) such as ChatGPT.<\/li>\n<\/ul>\n

          If the query data is not used today to feed the model, it could be in future versions.<\/p>\n

          The article points to increased risks in terms of cybercrime, such as the production of more convincing phishing emails, or the learning of new attack techniques.<\/p>\n

          He recommends not including sensitive information in requests addressed to public LLMs.<\/p>\n

          • The UK data protection authority, for its part, has updated its guidance on AI and data protection at the request of the industry.<\/li>\n<\/ul>\n

            The guidelines clarify the fairness requirements in AI.<\/p>\n

              \n
            • ITALY : <\/strong>LLMs are taking center stage at the start of spring. On March 31, the Italian data protection authority issued an order against OpenAI, blocking ChatGPT in Italy due to a lack of transparency, the absence of a legitimate reason for processing, failure to ensure the accuracy of the data processed, the lack of age verification, and a general violation of the principle of "privacy by design".<\/li>\n
            • CZECH REPUBLIC : <\/strong>The cybersecurity and antivirus company Avast has been fined 13.7 million euros by the Czech Data Protection Authority for violating the GDPR.<\/li>\n<\/ul>\n

              User data collected via Google Maps, YouTube, LinkedIn and, more broadly, web searches on Google, was sold through its subsidiary Jumpshot.<\/p>\n

              The Czech Data Protection Authority's investigation concerns the historical processing of personal data prior to January 2020, when Avast closed Jumpshot.<\/p>\n

              • NORWAY: <\/strong>The Norwegian Data Protection Authority (APD) has fined Argon Medical Devices 220,000 euros for delaying notification of a data breach due to systematic and extensive use of external consultants.<\/li>\n<\/ul>\n

                Such recourse to third parties was considered to unduly slow down the security breach notification process.<\/p>\n

                Norway again:<\/p>\n

                • Following one of the 101 complaints from the NGO NOYB concerning transfers to the United States, the Norwegian Data Protection Authority notified a controller of its intention to reprimand him for his use of Google Analytics and the subsequent transfer of personal data to the United States, in violation of Article 44 of the GDPR.<\/li>\n
                • Also in Norway, the Privacy Appeals Board upheld the decision of the Data Protection Authority to fine a municipality 352,555 euros for violating Article 5(1)(f), and Articles 24 and 32 of the GDPR following a ransomware attack that resulted in the irretrievable loss of highly sensitive personal data and its sale on the dark web.<\/li>\n
                • AUSTRIA: <\/strong>The Austrian Data Protection Authority (APD) has decided that the use of Facebook's tracking pixel violates the GDPR and the CJEU's "Schrems II" ruling on transatlantic data flows.<\/li>\n
                • BELGIUM: <\/strong>In Belgium, a public authority was allowed to invoke Article 6(1)(e) of the GDPR to geolocate the company cars of its employees, because there were no other less invasive solutions and the tracking was necessary for an efficient use of its limited resources.<\/li>\n<\/ul>\n

                  In this case, however, the data controller was reprimanded for several other violations of the regulation.<\/p>\n

                  • IRELAND: <\/strong>The Bank of Ireland was fined \u20ac750,000. The Data Protection Authority (DPA) found that the data controller had not adequately assessed the risks associated with the processing, nor implemented appropriate security measures.<\/li>\n
                  • SPAIN: <\/strong>The Spanish Data Protection Agency (APD) has fined Orange Spain 100,000 euros for violating the principle of data minimization by requiring a photo of the front and back of a customer's identity document in order to deliver a phone purchased online.<\/li>\n
                  • Still in Spain, a data controller who does not respond to an access request due to an employee error is nevertheless liable for the violation of Article 15 of the GDPR.<\/li>\n<\/ul>\n

                    • UNITED STATES : <\/strong>On March 25, the Federal Trade Commission published an article on its blog entitled "Chatbots, deepfakes, and voice clones," or deception via AI.<\/li>\n<\/ul>\n

                      The FTC points to a worrying emerging threat that companies in the digital ecosystem must address.<\/p>\n

                      The FTC's technology office also released an analysis and guidance on third-party tracking pixels, based on its recent decisions regarding digital health service providers.<\/p>\n

                      • The NIST (National Institute of Standards and Technology) is launching a Resource Center for trustworthy and responsible artificial intelligence.<\/li>\n<\/ul>\n

                        The goal is to support AI stakeholders in their development of these technologies.<\/p>\n

                        • SOUTH KOREA: <\/strong>South Korea's Personal Information Protection Commission has fined McDonald's, British American Tobacco and Samsung for privacy violations.<\/li>\n<\/ul>\n

                          McDonald's was fined 484,000 Euros for storing backup files relating to users of its McDelivery service on a server that left sharing enabled, which allowed hackers to access the data of 4,876,106 customers.<\/p>\n

                          In another incident, the data of 766,846 hamburger buyers was stolen, resulting in the company receiving an initial penalty of 7,000 Euros.<\/p>\n
