In Europe, the General Data Protection Regulation (GDPR) is the primary legal rule protecting citizens&#039; privacy. But is this rule, created when AI was less prevalent, still relevant with today&#039;s technologies? This data can include behavioral, biometric, geographic, or social media data. However, this massive processing raises crucial questions regarding:<\/p><ul data-start=\"1154\" data-end=\"1506\"><li class=\"\" data-start=\"1154\" data-end=\"1274\"><p class=\"\" data-start=\"1156\" data-end=\"1274\"><strong data-start=\"1156\" data-end=\"1172\">Transparency<\/strong> : algorithms are often opaque, making it difficult to understand data processing.<\/p><\/li><li class=\"\" data-start=\"1275\" data-end=\"1384\"><p class=\"\" data-start=\"1277\" data-end=\"1384\"><strong data-start=\"1277\" data-end=\"1289\">Purpose<\/strong> : AIs can reuse data for purposes other than those initially intended.<\/p><\/li><li class=\"\" data-start=\"1385\" data-end=\"1506\"><p class=\"\" data-start=\"1387\" data-end=\"1506\"><strong data-start=\"1387\" data-end=\"1403\">Consent<\/strong> : Is informed user consent actually obtained in complex AI systems?<\/p><\/li><\/ul><h2 class=\"\" data-start=\"1508\" data-end=\"1549\">GDPR: a solid foundation, but one that needs to be adapted<\/h2><p class=\"\" data-start=\"1551\" data-end=\"1848\">The GDPR imposes several fundamental principles such as the <strong data-start=\"1608\" data-end=\"1636\">data minimization<\/strong>, THE <strong data-start=\"1641\" data-end=\"1660\">right to be forgotten<\/strong>, there <strong data-start=\"1665\" data-end=\"1692\">data portability<\/strong> and the <strong data-start=\"1699\" data-end=\"1715\">transparency<\/strong>. While these rules apply to automated processing, their implementation in the context of AI encounters several obstacles:<\/p><ol data-start=\"1850\" data-end=\"2389\"><li class=\"\" data-start=\"1850\" data-end=\"2069\"><p class=\"\" data-start=\"1853\" data-end=\"2069\"><strong data-start=\"1853\" data-end=\"1878\">Right to explanation<\/strong> : <span class=\"sw\">the article<\/span>\u00a022 of the GDPR\u00a0<span class=\"sw\">establishes<\/span> a right not to <span class=\"sw\">be<\/span>\u00a0<span class=\"sw\">submitted<\/span>\u00a0has\u00a0<span class=\"sw\">of the<\/span>\u00a0decisions\u00a0<span class=\"sw\">completely<\/span>\u00a0automated.<\/p><\/li><li class=\"\" data-start=\"2070\" data-end=\"2230\"><p class=\"\" data-start=\"2073\" data-end=\"2230\"><strong data-start=\"2073\" data-end=\"2091\">Responsibility<\/strong> : In the event of a data breach or damage, who is responsible? The developer? The user company? The model publisher?<\/p><\/li><li class=\"\" data-start=\"2231\" data-end=\"2389\"><p class=\"\" data-start=\"2234\" data-end=\"2389\"><strong data-start=\"2234\" data-end=\"2262\">Detection and traceability<\/strong> : AI&#039;s collection and use of data is sometimes difficult to trace, especially in interconnected systems.<\/p><\/li><\/ol><h3 data-start=\"2391\" data-end=\"2419\">The major challenges ahead<\/h3><h4 data-start=\"2421\" data-end=\"2498\">1. Create ethical and compliant AI from the design stage (privacy by design)<\/h4><p class=\"\" data-start=\"2500\" data-end=\"2717\">It is becoming essential to integrate GDPR compliance from the design phase of AI systems. This\u00a0<span class=\"sw\">need<\/span>\u00a0compliance audits on a GDPR platform <span class=\"sw\">For<\/span>\u00a0<span class=\"sw\">ensure<\/span>\u00a0there\u00a0<span class=\"sw\">clarity<\/span>\u00a0algorithms.<\/p><h4 data-start=\"2719\" data-end=\"2760\">2. Regulate the use of generative AI<\/h4><p class=\"\" data-start=\"2762\" data-end=\"3067\">With the rise of generative AI (such as ChatGPT, Midjourney, or DALL\u00b7E), the question of the origin of the data used to train these models is becoming central. Regulators must be able to regulate the exploitation of this content without infringing on intellectual property or privacy.<\/p><h4 data-start=\"3069\" data-end=\"3116\">3. Train stakeholders in legal issues<\/h4><p class=\"\" data-start=\"3118\" data-end=\"3317\">Developers, project managers, and data controllers must be trained on GDPR and its implications for AI. This framework will complement the GDPR to better respond to the specificities of AI.<\/p><h3 data-start=\"3602\" data-end=\"3658\">Towards hybrid data governance<\/h3><p class=\"\" data-start=\"3660\" data-end=\"4072\">The crossing between <strong data-start=\"3680\" data-end=\"3706\">data protection<\/strong> And <strong data-start=\"3710\" data-end=\"3739\">artificial intelligence<\/strong> requires a balanced approach between technological innovation and respect for fundamental rights. The future will involve more ethical, more transparent, and better legally regulated AI. Companies must anticipate these developments now to remain compliant and gain the trust of their
